Unauthorized R999 charge after debit order cancelled + No affordability check + Refused payment plan but debt collector now offers plan - NDH57

I have been a Webafrica client since approx 02 May 2025 (***) and I am posting after failing to get resolution for months.

What happened:

1. Sold as "month-to-month" but treated as fixed-term: I was told it was month-to-month, but I was charged a R999 cancellation fee and the service was not disconnected for non-payment as per their SMS. Instead debt was carried over. This is a fixed-term contract under the disguise of month-to-month.

2. No affordability assessment done: At the time of sign-up I was unemployed and my then fiancé (now husband) whose card was used for the once-off router fee, was under debt review. No affordability checks were done in terms of the National Credit Act before entering into this contract. This is reckless lending.

3. No call recording provided: On 05 August 2026 I formally emailed Nombulelo at Webafrica requesting the call recording for my sign-up call on 02 May 2025 to prove disclosure of the R999 fee. To date (31 Aug 2026) they have failed to provide it, despite follow-ups.

4. Refused my payment plan, then took money from my husband's card: Against my better judgement I caved and offered to pay the R999 via a payment arrangement as I informed them I cannot afford to pay the full amount at once. Webafrica declined my payment arrangement and insisted on full payment only.

Immediately after I cancelled my debit order due to the dispute, Webafrica then processed R999 as a card payment from my husband's card without authorization, notification or consent. That card was only provided for a once-off router fee in May 2025, not as a stored payment method. The card has been cancelled and disputed with the bank.

5. Handed to debt collectors while disputed: Ironically, after refusing my payment plan, Webafrica has now handed me to LexMEd Debt Management (***) for R1148.10 (R999 + fees) while the matter is formally disputed with ICASA ***/26 (referred to NCC), NCR and NCC. And now the lawyers ARE offering me the same payment plan that Webafrica refused.

What I want: - Provide the call recording for 02 May 2025 as requested on 05.08.26 - Reverse the unauthorized R999 card transaction from my husband's account - Proof of affordability assessment done at sign-up - Confirm account NDH57 closed with zero balance and collection on hold

I have all emails, SMSs, and proof of request dated 05.08.26.

I will update this review when resolved.

Update - 31 Aug 2026 - Account in MY name (NDH57) but debiting HUSBAND'S account

To clarify my earlier post, as account NDH57 is in MY name, but because I was unemployed the debit order was on my husband's account:

- I requested resolution since beginning of this year and finally cancelled in May 2026 for month-to-month service.
- 2 months after cancellation, you took R999 cancellation fee via DEBIT ORDER from my husband's account. We reversed it at the bank and cancelled the debit order.
- Days later you took the same R999 from my husband's account as a CARD payment using his card details that were only provided for a once-off router fee in May 2025. We cancelled that card.
- My husband received a new card and you took the SAME R999 AGAIN as a card payment from the new card. Every month since you continue to attempt this, forcing my husband to go into the bank to reverse the charge.

Questions:

1. Why are you debiting a third party's (my husband's) bank account/card when the account NDH57 is in MY name? Where is his signed debit order mandate or card authorization for recurring R999 charges?

2. Why has no one called me to resolve this, yet you can access my husband's new card details after cancellation?

3. I requested the call recording for my sign-up call on 02 May 2025 on 05 August 2026 (26 days ago) to prove disclosure of R999 fee. Please provide it.

4. Why was no affordability check done when I was unemployed and my husband was under debt review in May 2025?

This is now with NCR (Form 29 - Reckless Lending), ICASA Ref WCP007152/26, and bank ***** department.

Please stop debiting my husband's account/cards and provide the above in writing.

@Webafrica Crew - You were given until today 12pm to provide:

1. Call recording 02 May 2025 (requested 05.08.26 - now 27 days overdue)
2. Husband's signed mandate for R999 recurring card debits (account NDH57 is in my name)
3. How you obtained his NEW card details after we cancelled the old card

No call, no recording, no written response received by deadline.

As of today, you are still attempting to debit my husband's account monthly, even after card cancellation. Bank has confirmed unauthorized card-not-present debits and is blocking your merchant code.

This review remains UNRESOLVED. Please do not ask HelloPeter to mark as resolved.

I am now proceeding with:

- NCR Form 29 Reckless Lending (lodged 31 July)
- ICASA WCP007152/26
- POPIA Section 11 objection sent to *** (awaiting 5-day compliance)
- Information Regulator complaint pending
