is this false advertising?

using a ISP that installed vumatel .. advertising says unthrottled and unshaped fibre.. but P2p being throttled. everytome i get a line upgrade i have problems with P2P .. not everything on P2P is ******* to download. Game updates use P2P to update the games. Yet on a 500mbps line i should be getting 50mbps but when testing and loading P2P to test speeds i get a maximum of 20mbps on downloads instead of 50mbps. this is false advertising
