Telkom lack of assistance & knowledge of the law

<p>My husband apparently has an outstanding account with Telkom ( ********** 03820). Last payment was made prior to December 2013. </p> <p>As we wanted to proceed to buy a house, we saw there is this outstanding account on his credit buraeu report. We attempted to contact Telkom regarding prescription alternatively just to make damn payment. No one could tell us where the account is or how to pay. Eventually they gave us MBD credit solution's number. Whom does not answer their phones!!!!!! </p> <p> </p> <p>Even though in terms of the prescription act "the debt became due" in Dec 2013, three years prior to now!! And according to section 126B(2) of the National Credit Act (as amended) NO PERSON may continue to collect of or reactivate a debt under a credit agreement to which the act applies - which debt has been extinguished in terms of the prescription act. WE STILL WILL PAY TO JUST GET THIS OFF OUR NAME! this is in actual fact ******* to collect these monies. </p> <p> </p> <p>Do note that prescription was never interrupted! and that such a telkom account becomes INCIDENTAL credit agreement (once a balance is due and any further charges are made to the account) and thus falls under the NATIONAL CREDIT ACT. </p> <p> </p> <p>MBD credit solution's should perhaps do some additional research on the law as Telkom can get in serious trouble if the contravene the ACT.</p> <p> </p> <p>We are in desperate need of assistance from someone!!</p> <p>Vanessa </p>
