TELKOM IS VIOLATING CONUSMER RIGHTS AS PER THE CPA

I had taken the 219 800 freeme special for a samsung A31 on the 14th of March 2021. It worked perfectly for a week, and after the software update was done on the 22nd the phone refuses to connect to WIFI, the phone worked perfectly for a week.

I went to Telkom at Mall of Africa an I was told that the their system is offline. And there is nothing that can be done which, I feel was a complete waste of time. My petrol, my time that needed to be taken off work was not taken into consideration. The only person that really tried to help me was a sales rep by the name of Tshepo. Who promised me that someone would call me to do a booking online. Imp**** warranty of quality In terms of s56 (read with s55) of the CPA, all goods sold to a consumer are sold with an imp**** warranty of quality, that cannot be contracted out of or revoked. The warranty gives the consumer the right to receive goods that: are reasonably suitable for the purpose that they are intended to be used for, are of good quality, free of defects and in good working order, and will be durable and usable for a reasonable period of time. If goods are found not to comply with these requirements then, for up to 6 months after receiving the goods, the consumer can: return the goods, or get the goods replaced, or get the goods repaired.

Your 7 day clause is constitutionally incorrect and is a violation of my rights as a consumer.

I am willing to get my lawyers involved to back me up here. Because as per The Consumer Protection Act I am entitled to a replacement device. Your 7 day policy is a rule that you have created it is not constitutionally correct.

I want this to be dealt with. What is my guarantee this is not going to be a recurring issue once the phone is returned.

Telkom your customer service is lacking big time and I am not afraid to put this on media and get this solved the legal route.
