Telkom-breach of agreement

Our ADSL line has been been faulty for the entire duration of our contract with telkom, which is just over a year now. We have continously logged faults and pleaded with telkom to fix our internet, and to uphold their side of the contract. Alas, our pleas have been a mere waste of time and money as our internet issues have continued without being resolved.

Two weeks ago, Telkom contacted us and informed us that the lines are faulty and they will not be replacing them, they informed us that we must cancel the agreement and pay a reasonable cancellation fee, and move over to their Lte service, thereby entering into a further contract with them and incurring further expenses. I am not sure if Telkom has any legal advisors, but I can tell you that these actions are completely ******** and their staff are misinformed.

In this light, Telkom has acknowledged and confirmed that they have breached our agreement and yet they believe that section 14 of the CPA finds application in said circumstances.

We have brought the above issues to Telkom's attention on multiple occasions and have requested that they remedy their breach as soon as possible. We have asked to speak to managers or legal advisors, however, we have been told that their is no one to speak to in this regard. So telkom is apparently run by telephone operators...

Notwithstanding the fact that we pay approximately R700. 00 a month for my telkom service, we have incurred thousands of Rands purchasing data because we cannot use our Telkom Adsl.

We have had no other option but to conclude a separate contract with another internet provider and cancel, our adsl line with Telkom, in terms of which, we had made it unequivocally clear that we wanted to keep the voice line and our telkom email service.

Notwithstanding the abovementioned requests, our adsl line was canceled and so to was our email. Subsequent thereto, we received a bill for R1700 - I'm not even sure where they get these numbers from, because our line is on a debit order and we have religiously paid for our FAULTY internet connection from the inception, and without delay.

Telkom's actions are completely ******** and if not resolved ASAP we will be taking legal action and reaching out to the media to forward others of such ******* practices.

This is pathetic now! Stop logging faults, it does not help. Everytime we speak to someone about reactivating our email, we are told that the systems are down. Your staff are clearly unable to carry out the task. We have asked to speak to a manager on numerous occassions, to no avail. What kind of a business is this? You have breached an agreement and instead of contacting the customer and resolving the issue you sit on the matter. This is absolutely appalling! How can you not just activate an email service? All of our accounts are linked to that email, and we are being denied access thereto due to you cancelling the line. Am I to assume that you would like us to take this matter to court and that we ought to reach out to the media?
