So why is it that Telkom mobile so privileged not to comply Section 14 of the consumer Protection Act.
<p>I have requested a cancellation for 2 numbers ( 2 accounts) on the 16/05/2016. On the 20th 0f June 2016, the response that was noted as, “Also note that we acknowledged your request and that the number 08133........./08135.......... has not been cancelled as per your request because your contract is still within it's maturity stage as your current contract is on it's 17 months , 16 days.”</p> <p>I followed up with an email response on the 24th June 2016, noting that their decision was grossly unfair as Section 14 of the Consumer Protection Act dealing with the expiry and renewal of fixed term agreements does NOT apply to agreements entered into between juristic persons, irrespective of their turnover or asset value. In that a consumer may cancel such an agreement before the agreed expiry date by giving the supplier 20 business days written notice. No reasons for the cancellation are required. A supplier may also terminate the agreement prior to the expiry date if the consumer fails to remedy a material breach on his part, after having been placed on 20 business days terms to do so. Consumers should make use of the form contained in Annexure B of the Regulations when giving notice of early cancellation to a supplier.</p> <p>Furthermore to this is that is noted that your consultants on the number 081 180, advise consumers that penalties are calculated at the rate of monthly payment multip**** by the time remaining on the contract, i.e. the full amount owing in respect of the remainder of the contract. This is violation as it does not comply to legislation. Also believe that this puts the consumer at odd on whether to cancel the contract or not. Hence the consumer is put at a disadvantage and their rights are infringed.</p> <p>I have contacted Telkom via their call centre on the 13/05/2016 and the 24/06/2016 and have emailed them on the 24th of June 2016 at 12h29 PM and 3h22 PM and the 28th of June 2016 at 10h10.</p> <p>To date, I have no received at feedback from Telkom. This is extremely disturbing. As such I have decided to complain to Hello Peter. I will continue to complain as I find this to be a direct violation to my rights as a consumer. I will also inform Telkom via the ********** of my posting on the various consumer complains' platforms. This way they are aware that I’m not willing to accept any additional costs.</p> <p> </p>
