Prescribed Debt
Account No: ***
Dear Telkom,
I refer to the above account appearing on my credit profile
Kindly be advised that this account was opened 2012 and was last paid since then
The amendment to the National Credit Act, 34 of 2005 was gazetted on 13 March 2015, this was after the sale
Prescription is a defence in law that can be raised should there be no payment, express or tacit acknowledgement of debt for an uninterrupted period of 3 years in respect of personal debt. Often a detailed factual investigation may be required in order to ascertain whether there has been an acknowledgment of the debt & I can confirm no debt has been acknowledged
Amendments to the National Credit Act specify certain requirements when potentially prescribed debt is being collected on. This in practice requires a debt collector to ensure that a debtor is aware of the defence of prescription when attempting to collect on a potentially prescribed debt.
As such debt has been prescribed.
Please remove it and also submit the electronic file to the relevant credit bureaus, for my profile to be amended.
Kind regards, Bazil
