Paying for stock i dont have

We took 2 contracts from Telkom about 2 months ago, the special included a powerbank for each phone. We still did not get this stock and we are paying for the whole package. So I believe Telkom is in trouble for false advertising as we are paying for something we are not getting. 30 November will be the last day for Telkom to deliver this to me else we will take the legal route.
