Misrepresented Mobile Phone
Good day.
On Friday 29th of November, I purchased a mobile device at Somerset Mall, Telkom branch. Upon my arrival I let the salesperson know which phone I want from the number of phones I had on my list. I was specific to say I need a phone with Google services as most of my apps from my previous one were from the Play Store. Only one phone from the list I provided was in the store which I said I was interested in. The salesperson then told me there is a brand new Huawei available and they now accommodate Google Playstore. I asked to view and browse the phone from the display phones and he told me I couldn't as the phone's battery was low but he guaranteed me that it does have the Playstore. I then proceeded with the purchase and received the phone. The store manager then came over to assist me with the phone clone and I told her not to worry I know how to do it I'll do it at home, she then said she would open the phone box herself and switch it on to see whether the phone works or not, she then took out the phone and switch it on and then off again and placed it back in its box. I left the store. When I arrived home and switched the phone on to activate it, I noticed that the phone did not have the Playstore also the storage on the phone was not sufficient, and could not take my apps and other content, some of the apps said they were not compatible. I then called the 081180 number to enquire about the return policy the consultant let me know that I was still within the 7-day cooling period and could return the phone and get another for the same price. The next day, in less than 24hrs I went back to the store to return the phone and was told I could not return it, only if there was a factory fault with the phone. I then told them that there was nothing wrong with the phone but it was not what I was looking for or what I was told it had, the manager then said to me there was nothing she could do, once the phone is open there are no returns I told her that the sales person sold me the wrong phone, she says she can't help me if it was her who sold me the phone she would've told me it does not have the Playstore and how much storage the phone has so it's not her fault. The option she gave me was to cancel the contract and I will be liable for full costs and the penalty costs.
It has been 4 days now and I have the phone with me, still in its original package. I believe the phone was misrepresented and sold to me under false pretense and I am now liable to pay for it for the next 24 months for a phone I can't use. I asked not to cancel the contract but to rather receive another phone or the one I initially wanted which is of the same value as the one I received.
