Gross infringement of my consumer rights

On the 15 June I sent an email to the Telkom Escalation department explaining that I had received my monthly bill and to my surprise I found that I was invoiced for a service I had not expressly confirmed I wanted.

A sales person contacted my about on the 30 May from this number ********** asking me whether I wanted to upgrade my existing line from a 2Mbps line to a 4Mbps line with Uncapped data with a free router and a TI mobile data sim. – UNLIMTEDhome4Mps @ R605 https://secure.telkom.co.za/today/shop/home/plan/fibre-uncapped-internet/

When having this conversation I considered the product and wanted to commence using Telkom as my complete internet service provided from the 1st of July. Until the consultant said to me that it would be a 24 month contract. I then said I wasn’t interested he responded that I could also have it month to month basis but I would not receive the router. I conceded because I was happy with the month to month until he went thru a series of question which he wanted to know my salary. I responded that I was not comfortable in disclosing this information and I was no longer interested. He told me that he would “make up” a salary number. R10 000 I thought to myself this would never be approved because if they did credit vetting or if Telkom did any kind of vetting it would not be successful. Because the sale consultant just made up ********** information. I received sms at 15:52 30 May that read my order was receiving further attention. Communication will follow.

On the 14 Jun I received an invoice with the subscription unlimited Home DSL. Furious because my consumer rights had been grossly infringed. My right to Fair and honest dealing and my Consumer agreement right.

I then contacted Telkom outraged with the commenced of the subscription without my consent. Furthermore wanting to know where were the products they were charging me for and when did this technician come to and change the line as I was lead to believe would happen? The only information I response I received was from Akhonathi claiming that they could not contact me. I emailed her back 10 mins explain that I was with a client and that she should call me back. I received no response since.

But I definitely sure that they are still charging me for a service they *******ly started to charge me for. I also would like to know where is the products you are charging me for?

I am not a sheep I will not be bul**** in paying for something I did not want. I am protected by the consumer ACT of 68 of 2008 and so is everyone else on this platform.

The Act allows class actions in the form of accredited consumer protection groups, which groups may act to protect the interests of a consumer individually or of consumers collectively. It determines that any of the following may approach a court, the Consumer Tribunal or the National Consumer Commission on the basis that a consumer's rights in terms of the Act have been infringed:

• a person acting on his/her own behalf

• a person acting on behalf of someone else who cannot act in his/her own name

• a person acting as a member of, or in the interest of, a group or class of affected persons

• a person acting in the public interest

• an association acting in the interest of its members.

You probably shrug me off because I am one person. Just remember you have 1 00 000 of clients who probably feel the same way.

What do I want? A resolution. I want someone to contact me.

Kind regards,
