Formal Complaint – Harassment & Prescription of Account

I am writing on behalf of my spouse, Mr Thubalakhe Felezweni Mthethwa ID number (***), for whom I hold full Power of Attorney (POA). Kindly note that he has been included in this correspondence.

This email serves as a formal complaint of harassment against P&P Attorneys and Telkom SA. Mr Mthethwa has been receiving repeated calls and SMSs threatening garnishment of his monthly wages in relation to an alleged contract, which is disputed and has caused significant distress and a negative impact in his workplace.

In terms of the Prescription Act 68 of 1969, any debt for which no payment has been made for a period exceeding three years is generally considered prescribed. Based on this, we formally request that the account be reviewed and confirmed as prescribed, as Mr Mthethwa will not be liable for payment on a prescribed debt.

Furthermore, we demand that all communication regarding this matter cease immediately, including any contact with Mr Mthethwa’s employer or HR department, as this constitutes an invasion of privacy and is unacceptable.

Should the calls, emails, SMSs, or third-party contact continue, we will have no alternative but to escalate this matter further through the appropriate legal and regulatory channels.
