False advertising i.r.o. ADSL Uncapped

<p>In 2011/11/09 I got Telkom TI Do Uncapped Advanced. I got a Duo Plus 300wr a letter with my Access details, Email account details, Service Domain Details, and explanation on what Telkom offers, some quick tips and useful info on speed up options. There was problems with getting the proper lines installed so on 2012/01/17 we finally got our ADSL Uncapped 4mbp line activated. I have a copy of our Smart Access online order form that the Telkom agent handed me on the day. </p> <p>Kindly note that I was never informed of the Telkom Internet Acceptable Use Policy which a customer is supposed to be informed of during activation. It is now 2016.06.28. I was experience difficulty accessing ADSL and thus phoned in to 10210 to ask what was wrong. I was informed that I had exceeded 200 G download and that a throttle had been placed on my account until the end of the month. Now this is in contravention of Telkom policy since Telkom never informed me of the restrictions at time of activation, regarding usage behaviours, since Telkom had not informed me at any time in June 2016 that restrictions are active on my account and that my internet access will be restored but with restrictions until the end of the current month. I had to phone in to get told this. This is false advertising by Telkom! I purchased an UNCAPED ADSL not a capped/throttle line. Also the url link the call centre agent gave to me to track the approximate data usage at https//secure.telkomsa.net/titracker, is not helpful, since now BEFORE I'm allowed to access this, I have to click a the "ACCEPT & CONTINUE" button which acknowledges that: "2. Accept that you have been informed that your account has restrictions app****. :</p> <p>When I insisted that the call agent send me in writing this information she had imparted to me regarding the "throttle" in other words "capped" internet, which I had not agreed to, she first refused, then said she didn't have the option and I needed to contact the sales department? Then when I further queried it she then referred me to the service centre who will be able to send me the e-mail I've been requesting. </p> <p>So Telkom is in my opinion falsely advertising and selling ADSL as UNCAPPED but then "cap/throttle" my 4mbp line due to me either downloading too much (which I don't agree with, but cant check to see if my account has been "loaned out/hijacked" by someone else, because they can't send me the month list of websites accessed unless I log into the account, where I have to accept their conditions of acknowledgement, which I won't, since I don't agree with it!).</p> <p>I expect Telkom to provide the service I am paying them for, a constant access via 4mbp uncapped line, no restrictions and that the access to the line speed not be affected due to Telkom's inefficiency to provide other clients with their assigned line speeds. Telkom is not giving me a rebate on my monthly subscription when the line falls below 4mbp.</p> <p>This is a contravention of my consumer rights. </p>
