Disregard for Consumer Protection Act

Consumer rights are disregarded. Telkom is in breach of contract and refuse to comply with the contract terms and conditions set by them.

I sent a device for repair and the product was evaluated as faulty. It is still in the 6 month warranty period, and as stipulated by the Consumer Rights Act below (copied directly from the terms and conditions on the Telkom contract signed)

8.1.7. Where on inspection it has been found that the Devices are not in accordance with the standards set out in section 55(2) of the CPA as the case may be, and Telkom has discussed the matter with the manufacturer or supplier who has then agreed to accept responsibility for the ascertained defect, then Telkom, on behalf of the supplier and/or manufacturer will either, at the option of the Consume: 8.1.7.1. Repair or replace the failed, unsafe or defective part of the Devices; or 8.1.7.2. Instead, at the election of the Consumer, refund to the Consumer the price paid by the Consume r, for the returned Devices, less any reasonable Usage Charges, as defined under clause 1of the Agreement.

As stated above, if evaluated as faulty, the consumer may decide to repair or replace.

Telkom refuses to replace, and unfortunately due to these circumstances, I shall have to take the route for this breach of contract. Such a simple problem with a simple fix.

@AutomatedTelkomResponse I will not go discuss this in store, as no one wants to take responsibility; I have gone many times. Telkom shall be held liable, and see what happens when this is exposed.
