Data contract not being cancelled by Telkom resulted in client being handed over to debt collector

On 30/10/2016 I gave Telkom notice of the cancellation of my data contract as the contract expired on 30/11/2016. I completed a Telkom “Consumer Request for Contract and Service Cancellation” form. In spite of the contract ending 30/11/2016 and my request to cancel, Telkom continued to deduct money from my account 6 months after the contract expired. I have never requested the contract to be extended or gave any authorisation for further monies to be deducted from my account. Every month I had to consult with the bank to have these debit orders reversed – once again these debit orders were done after expiration of the contract, without my consent.

In spite of cancelling my contract, upon expiration of the contract Telkom notified me on a continuous basis that my account is in arrears. I went to the Westgate Telkom branch to have the issue sorted and spoke telephonically with a Telkom sales consultant named Constancia who informed me that I will be handed over to debt collectors. As requested by Constancia I have sent all the required information relating to various efforts by myself in which I’ve contacted Telkom to enquire why they did not cancel the contract as per my request dated 30/10/2016. In spite of sending Constancia all the required information she is yet to respond. I have 5 different reference numbers available which is an indication of efforts to solve this issue with Telkom however to no avail. An agent called Daniela at the Telkom Westgate branch received and signed the request for cancellation form on 30/10/2016. During one of the calls the customer care operator at the time confirmed, telephonically that they “forgot” to cancel the contract. Unfortunately I cannot recall his/her name however I will be more than happy to provide all the reference numbers whereby you can track the calls and verify the content of these calls. I have been contacted by various debt collectors however every week is someone new and they are never available on the contact details they provide. On 25 July 2017 I was contacted by Kobus of Nu Debt, contact number ********** 078, email ********** whom informed me once again that I was handed over by Telkom due to my account being in arrears. Kobus requested various information via email and whatsapp and in spite of sending him the required information, Kobus is yet to provide any response. I have called Kobus on the above number however receive getting “mailbox is full” responses. He also does not respond to my emails or whatsapp replies. I also find it highly unacceptable and unprofessional to be contacted via whatsapp. Lastly, also as per Kobus’s email he stated “ be advised that you current landline number under this contract will not be ported or be made available to you if the amount outstanding is not settled”. Confirm receipt and advise the way forward as I will not tolerate further harassment or threats of any nature due to Telkom not DOING THEIR JOB!!! I am now at the point of seeking legal advice as I am now fed up with all the threats and non-existent service.
