Contract cancellation request in terms of CPA - Case Number ***1
<p>My contract was signed and processed at the Telkom Shop in The Glen Shopping Centre on the 21st of July 2017 at approximately 20h30 (just before closing time).</p> <p> </p> <p>I have since changed my mind about the taking the contract and went to the Telkom Shop in THe Glen Shopping Centre again on the 28th of July 2017 @17h00 with all devices in original packaging to cancel my contract under the 7-day cool off period (CPA).</p> <p> </p> <p>Upon my arrival at the Telkom Shop in The Glen Shopping Centre the staff informed me that they cannot cancel my contract. I then took the liberty of writing a letter (attached pdf document in case submission) to confirm what has transpired and what the intention of my visit to the Telkom Shop in The Glen Shopping Centre.</p> <p> </p> <p>The staff refused to sign the attached drafted letter and instead scanned it in and sent it to the Telkom cancellation department and to the store manager of the Telkom Shop in The Glen Shopping Centre as part of a cancellation request.</p> <p> </p> <p>At this point, it is not clear whether Telkom have processed my contract cancellation and might force me to serve out the full length of the contract despite the on-time cancellation in accordance with the 7-day cool off period (CPA).</p> <p> </p> <p>I have opended a cancellation request (after much drama) in store and the case number obtained was: ********** 1</p> <p> </p> <p>I brought the device back to the store and they informed me that no CPA returns can be done in store...</p> <p>What baffles my mind in this regard is that the Telkom contract cancellation form even says "Copy of receipt for CPA cancellations with a device return".</p> <p> </p> <p>As a back-up to the in-store cancellation (CASE ********** 1), I have also submitted a form "Consumer Request for Contract and service Cancellation" to ********** with no cancellation affected to date.</p> <p> </p> <p>Section 121 of the National Credit Act allows a consumer to terminate a credit agreement within five business days (excluding weekends and public holidays) after the date on which the agreement was signed by the consumer.</p> <p> </p> <p>Telkom customer services, please assist to yet another lost Telkom case.</p>
