Contract breach by removing night-time surfer data
It all started when we app**** for the 50GB + 50GB night surfer + device data contract, it took Telkom a total of 3 weeks to vet the application. That is besides the point. So on Monday evening, 25 April 2015, after much deliberation we decided to change our cloud storage service provider from OneDrive to Dropbox. We have just had a baby, so knowing that I will be woken after 12am it came very easy for the process to be started, with the intention of using some of the allocated 50GB Night surfer data rather than the 50GB daytime data. So after starting the process at 00:39, I check everything as the night goes along. Tuesday morning to my surprise I have a Telkom "OOB" (Out-Of-Bundle) notification when trying to access the internet. Thinking to myself that it is very strange I make the call to Telkom to find out what the problem is and how they are going to fix it, you see the connection is used for our business with a lot of advertising done online and replies received online. So the call centre agent takes the call, after explaining the dilemma to him I am put on hold so that he can investigate. 5 minutes later he returns to the conversation and explains to me that we no longer have the 50GB night surfer data, what? We no longer have the 50GB night surfer data? How is that possible? Did we, without my knowledge, change our contract? Oh no, he explains, Telkom has removed the contract from the system, all clients were notified that they are to migrate their packages so that they can keep the night surfer data package. I asked him how and when this notification was sent out because not my wife or I received it. So they log a query onto their system (case #: ***9) mark it as urgent, someone from the data technical department will call me back. Wednesday I get a call, the lady tells me that she has received the query and would like to assist me. So I explain the whole story again. She has never heard of the contracts being changed and that clients have to migrate their contracts. She does however give me a whole story about how I have to turn my device off after 12 to log into the night surfer servers to access the night surfer data. What? So you are telling me that tomorrow morning I have to restart my device again to log into the daytime data server? Somehow I think that is a ******* story. I ask her what they are going to do about the fact that their system did not use my night surfer data but depleted my daytime data and I now can't do business for the rest of the month? They are not going to do anything about it, if I want service I have to buy a extra data package that will last me to the end of the month. I asked her to speak to someone senior that can make a decision, after which I was informed that no-one is available and she will forward my query to the supervisor whom will contact me in turn. Well it is now 17:16 on Friday, 29 April 2016, and I have not received any communication from Telkom. I probably will not receive any communication from Telkom as tomorrow is the end of the month and at 12am I will be allocated a new 50GB data bundle for the month of May and my problem will be solved. No Telkom, my problem will not be solved, my problem still exists! Where is my 50GB night time surfer data as per the contract that we signed? I will be consulting the CPA to find out what our recourse is, as we are not in the same position as what we signed a contract for.
