Cell Phone sent for repair

On 2015-08-22 I dropped my phone off to be repaired & was told that there was no paperwork to be completed. I insisted that I at least get a note acknowledging that I had left the phone, and was given a hand written document. I was advised that I would receive an SMS when the phone was ready and it would take about 3 weeks.
On 2015-08-24 I received an SMS advising that the phone had been booked with Ref. No. given
On 201508-26 I received an SMS advising that the phone had been allocated to a Repair centre for repairs Ref No given and that I would be contacted with updates
On 2015-08-31 I was send an SMS advising that my device has been deemed out of warranty and had been quoted for R1 197.00 to be repaired
A few days later I was called to see if I accepted the quote and that if I didn't that there would be a charge of R188 assessment fee
During this whole process I was not made aware that there was even a possibility of the repair being our of warranty as I had bought it earlier this year and certainly was not advised at any time that there would be an assessment fee payable
I can now not get my device back unless I pay the said fee!
Please can you assist.
