Broadband LTE uncapped FUP contractual change
<p>I am a subscriber to the broadband LTE uncapped service, and the only reason I signed up for this contract was for streaming Showmax, Netflix and YouTube.</p> <p> </p> <p>It has come to light that the terms and conditions attached to this deal have been amended by telkom and now have implemented a "soft cap" on all protocols including streaming of media. </p> <p> </p> <p>I accept that some users have been abusing the deal, you will always get the small percentage that do that, but to change the terms and conditions of a contract in such a way that it goes against the initial marketing ploy is against the ethos of the CPA. I am not one of these abusers, and have only used my contract for the purposes it was marketed for and reject these changes. </p> <p>I understand that telkom is now offering to release these contracts without penalties as an obvious admission of guilt - but this is simply not good enough. For me to migrate to a similar deal that offers what this had originally promised will cost in excess of a grand a month. This is a real loss to me financially and cannot be tolerated, a contract is a binding agreement and advertising leading up to this contract establishment is deemed as part of the contract.</p> <p> </p> <p>This is entirely unacceptable, I am certain that the legal team at Telkom are well aware that there are two parties involved in a contract. If I, as a user, need to cancel a binding contract I have to pay a "reasonable" cancellation fee (calculated as a percentage of remaining contributions) plus an administrative cost (as per the CPA) - this is protection of the financial rights of the business, however, if I am forced to migrate to a new supplier to provide a service originally contracted for at a higher cost, I am sure it can be argued that my financial rights within the contract have been infringed upon, and a "reasonable" compensation should be levied to myself - this being the difference in cost between the offerings. This is only fair and reasonable and I am certain is going to be successful in court. </p> <p> </p> <p>I would appreciate a more thorough response to this complaint than the usual "your complaint has been noted and here is your reference number" </p>
