Breach of contract by Telkom
Without prejudice, with my rights strictly reserved.<br> <br> On 5 February 2016 I entered into a telephonic agreement with Telkom for an LTE uncapped service to be rendered. I had an existing 10 GB LTE contract with Telkom and was assured my Mr Mzimela that I could migrate to the newer and more expensive contract. He explained to me that the migration will work as follow: I would enter into the new contract and then be able to cancel the existing contract free of charge (no cancellation fee) once the uncapped service was activated. He explained that they (Telkom) do it in this way in order to ensure that their customers do not sit in a situation where they do not have internet while their new package in being activated. (The call was recorded by Telkom)<br> <br> Today, 22 February, after my uncapped account was activated on 18 February, I attempted to cancel the 10 Gig contract as was agreed upon in the telephonic contract used to activate my uncapped LTE. This request, was refused in clear breach of our telephonic contract.<br> <br> As agreed upon Telkom will cancel the 10 Gig contract entered into previously and confirmation of this cancellation will be communicated to me.
