BREACH OF CONTRACT

To whom it may concern,

I took out a cell phone contract (Samsung Galaxy S8 - R579 deal) on Sunday morning 21/01/2018 by Telkom Blue Route Mall Tokai. Yesterday evening the cell phone did not want to charge 22/01/2018, tested the charging adaptor & cable, found out the charging adaptor was not working (had to charge via PC). To elaborate when i say test, i had a spare Samsung Galaxy S6 charging adaptor (worked fine with that), however did not want to use as it is a older charging adaptor. Took everything back today 23/01/2017 to Telkom Blue Route Mall Tokai to get a replacement charging adapter as it is still within the 7 day period (not even 2 days old). The consultant that assisted me tested the charging adaptor & cable & confirmed the same thing i told him that the charging adaptor is not working. He then advised that he has to book in everything & they will send it away for testing & repairs, it will take 14 to 21 days. I asked the consultant why must i wait so long & i just got the phone & it's still within the 7 day period as stipulated in the contract & was explained by another consultant that helped us on Sunday 21/01/2018 with the deal, & advised 'if anything is wrong they will replace it if within the 7 days, anything after 7 days will need to be sent away etc.'. Showed that part of the contract to the consultant he then went to got speak to the 'SHIFT MANAGER' (who never came out), the consultant was adamant about them booking in the device, saying that the phone & charging adaptor will be tested & the phone will be wiped. I ended up walking out as that is a BS answer, this is an inconvenience. Wanted to cancel the contract & got told i must pay R800 plus the first month’s instalment R579. SO WHERE IS THE 7 DAY PERIOD THAT PROTECTS ME AS A CONSUMER? I BASICALLY GOT ********** BY TELKOM!!!

Called Telkom Direct today 25/01/2018 in Canal Walk advised of the situation, was told by the agent that since the phone is still within the 7 day period Telkom Blue Route Mall Tokai is supposed to take in the entire device & give a new one. Called the branch manager at Telkom Blue Route Mall Tokai today 25/01/2018, he advised the same BS & refuses to swop the entire device (ALL I WANTED IS A CHARGING ADAPTOR REPLACEMENT) as they are a FRANCHISE store. He stumbled over his words as he had no proper answer when the exact contract words were read to him as he is going against CONSUMER PROTECTION ACT. He then advised to take it to Canal Walk Telkom Direct or Samsung store with all the paper work & see if they will just change the charging adaptor. This is an inconvenience for he could have at least offered to call & find out if they will & the process. So does that store follow their own rules/policies/regulations & go against Telkom & the CPA’s actual rules/policies/regulations? I have emailed on the Telkom website. I have messaged directly to their Facebook page. I posted on Hello Peter. No response at all. I could not get through to a call centre consultant to lodge a complaint to get a reference number for tracking. Is nobody going to assist me? All want is a replacement charging adaptor! SO WHERE IS THE 7 DAY PERIOD THAT PROTECTS ME AS A CONSUMER? I BASICALLY GOT ********** BY TELKOM!!! CLEARLY TELKOM HIRE’S *********** STAFF & MANAGEMENT, JUST TO TAKE US THE CONSUMER FOR FOOLS & THAT JUST DON’T CARE ABOUT THEIR CUSTOMER’S If I don’t get help I will be escalating the matter even further!

Hi Launa I'm still waiting on someone to contact me. I have been messaging on the Telkom Facebook page & all they can tell is "they apologize for the delay, that my query has been sent to who ever & that someone will contact me back". Still nothing!!!!!
