Breach of Contract
Telkom offers a month to month contract for broadband packages which means within a month you are able to terminate the agreement. 4.1.4 of the Telkom Mobile Subscriber Terms & Conditions "4.1.4 Any Month to Month Agreement as envisaged in terms of clause 4.1.1 or 4.1.3 may be terminated by either party by giving one (1) months written notice to the other party."
This is also a legal requirement of the Consumer Protection Act.
I have sent notice on 14 July 2017 and up till today, 21 August 2017, I have not received any confirmation of termination. From my telephonic discussions with Telkom agents I can confirm the following information was given to me: 1. Even though my contract should have been terminated on the 14 August 2017 I have received my full data package for the month of August so that Telkom can bill me for the entire month of August (call #1 on 2nd August 2017). 2. Telkom agent will forward my termination application to the terminations office because it seems my contract has not been listed to be cancelled. I will receive a call from the agents manager to confirm my case has been escalated. Call was meant to be received on the 18th of August 2017 but this did not occur (call #2 on 18th August 2017). 3. Telkom agent cannot find any record of my termination nor any subsequent case that was made regarding this cancellation. Telkom cannot acknowledge that my contract will end by the end of August 2017. There is a possibility that my contract may extend into September.
Point 1 above clearly indicates that the "month-to-month" contract term is flawed as August should have been pro rata billed and not for the entire month of August. Point 2 above shows that the terminations department of Telkom or the termination process itself does not live up to the terms and conditions Telkom sets. Point 3 above indicates there is a lack of concern regarding the legality of terms & conditions from Telkom staff.
Realistically speaking, many service providers make the process of termination extremely difficult. They do this to prolong and complicate the cancellation process and hopefully get another payment or more from you. Case in point: There is no possible way for a Telkom subscriber to make telephonic communication with the cancellations department. They can only call you. What Telkom and other service providers fail to realize is that this behavior deters a person from any future business interactions. I too considered going back to Telkom at a later stage in life. I now most certainly will not. I hope my experience deters you from entering into any agreement with Telkom.
