ABUSE BY TELKOM MOBILE. BLATANT BREACH OF CONTRACT AND OVER BILLING

<p>I took out a contract for my daughter from telkom mobile on the 20th December 2014. As it was for my child, I was VERY CLEAR on the contract to stipulate a Limit as once the contract call time and data finishes, it gets charged for. The contract was R199pm and I set an additional R25pm limit. For nearly 18 months it was fine but 3 to 4 months ago they suddenly started to overcharge me. After many many phonecalls I reached an agent who would look into it. I explained that I have my contract in hand and specifically set a limit and specifically selected COMMUNICATION METHOD AS EMAIL, and NOT SMS as there is no way they can communicate with me by SMS on that number as it is for my child. My contract proves the above. <br /> <br />What came out in this call is that they had smsed my daughter asking if they could remove the limit and took the reply of a child as a legally binding contract. Foolish but true. This call is recorded fortunately and I have the copy. I explained that my selection of communication is clear on the contract as is my written limit and a child can't enter into a legal agreement to which she finally agreed and agreed to refund me within 14 days as I had been charged approximately R330. She undertook to change the limits back.<br /> <br />This did not happen! Instead I was NOT REFUNDED and was charged a further R540 in August. I called and emailed multiple parties including Dennil Fransman who in the end refused to correct the situation despite the clear breach of contract by telkom and instead advised me that I need to take it up legally with icasa as that is the only time I will get to deal with a telkom legal person . (I had asked to speak to a legal team member as I knew they would realise their breach). Dennil said he would correct the limit. I told him I had heard that now numerous times.<br /> <br />I have since contacted icasa and have been put in touch with the Consumer Complaints Commission with whom I am filing a charge. I have MANY RECORDED CONVERSATIONS and MANY EMAIL TRAILS to prove the extent to which Telkom has abused their power and taken advantage of me and over billed me as a customer. Their breach of contract and the way they have gone about it is disgusting and once the charge is complete, I am considering releasing the entire docket to the media as no doubt this abuse and breach isn't isolated and I'm sure many others are being over charged. Incidentally I have just received an sms saying I owe R700+ for this month's billing..... there is just no ending of this situation which has gone on since June. I will never ever again use telkoms services. It is IMPOSSIBLE to get to a person who is able to look at a document, listen to a recorded conversation and take a decision. Absolutely ridiculous.</p>
