Breach of contract by who?

I signed up with me & you mobile sometime last year and have been quite satisfied with deal I received thus far. I received an email and sms this week stating a fair usage policy and that I am in breach of contract unless I purchase 50mb of data every month. As far as I am concerned, I did not accept any t&c's stating that data must be purchased when I took out the contract.

I do not think that in terms of the Consumer Protection Act, this change in usage policy and t&c's is legal. If Me&You is confident that they are allowed to enforce a new policy on a consumer after the initial acceptance than please explain how do you bend the law to do this.

Hello moememi,

Upon taking up the Unlimited Talk deal, there is a Fair use policy which forms part of the agreement that you would have had to agree to before taking out the deal. The deal is available to view on the website, and was discussed directly below the deal when purchased.

We have these clauses in place to ensure that all of our customers have access to our product offering.

Many thanks,
