Persistent Harassment by Elite Mobile

Elite Mobile persistently harasses me my calling me at all hours of the day from an unknown number. Sometimes the call connects and sometimes it doesn't. I'm running a business, my phone is for my convenience. I've asked this crowd on several occasions to stop phoning me. They persist. I've registered my details on the do not contact registry. Elite Mobile still calls. If Elite Mobile contacts me again, I'm filing a ******** complaint of harassment with the police.

As requested, please delete your message containing my number. Further, I've escalated this to Hello Peter for a data privacy violation. I don't think they're going to be happy about your comments about their functionality. Bottom line, you've improperly disclosed my personal information in a public forum, that is a data breach.

Not only has your company not solved any of the issues, your company has created more problems. Given Elite Mobile's failure to address the issue of my personal telephone number being posted to this thread, I had to contact Hello Peter to have my telephone number removed from this thread. I've forwarded you the correspondence with Hello Peter as evidence. The level of incompetence and irresponsibility with respect to data processing demonstrated by Elite Mobile is shocking. That incompetence and irresponsibility is made worse by your company having falsely claimed on this thread that the improper disclosure of my personal information would somehow magically be hidden by Hello Peter. Not content with harassing me, improperly disclosing my personal information, and failing to address the data breach, Elite Mobile then signed me up to its help system without my prior knowledge or consent. I just received an e-mail from the Elite Mobile help system informing me that my personal information (name and e-mail address) had been improperly used by Elite Mobile. I'm now complaining to Vodacom failing which I will file a GDPR complaint with the EU authorities against Vodafone. This matter will be dealt with properly whether Elite Mobile cooperates or not.

Please be advised this was a human error that the number was filter on the site and thank you for reporting to Hello peter to have this removed. We were also in the process of doing that.

Kindly be advised, we have removed your number from our system and have requested assistance from IT with regards to having your details removed from our data base, please also be advised that as proud members of the DMASA (Direct Marketing Association of South Africa) we assure you that we are compliant and take customers very seriously that do not wish to be contacted.

We urge you to please consider following this easy procedure to prevent any direct marketing telephonically, SMS OPTOUT followed by your ID number (this is crucial) to 39118. You can also visit the website www.nationaloptout.org.

We will suggest if you have more than 1 mobile number that you register all your numbers on the Do Not Call list.

Where we got your details

Your details were obtained through a marketable database, built up over a period of time by different vendors.

Under current South African legislation, data collected in this way may be used for direct marketing purposes and it operates on an opt-out basis. This means that consumers must opt-out appropriately to avoid future communications. Soon the system will change to an opt-in system, where consumers must give their permission before any contact can be made with them.

Again, we sincerely apologize for any inconvenience we may have caused.

I did register with DMASA a few months ago. Moreover, I had told your staff to remove me from your call system. In other words I had opted out in line with current legislation. It’s simply not open to you to even suggest that you’re in the right on any point. Your business practices as I’ve experienced them are despicable. You’ve ignored my opting out. You’ve disclosed my personal information inappropriately. You’ve dismissed my concerns by misrepresenting Hello Peter’s functionality. Please, spare your mealy-mouthed and utterly disingenuous apology. I’m in the process of contacting the appropriate Data Protection Authority in the EU to bring a formal complaint against Vodafone for the conduct of Elite Mobile, which is affiliated to Vodacom—a Vodafone subsidiary. As mentioned previously, you’re going to be dealt with for your negligence.
