Will break your house, walls etc. SIMPLEX ICT WILL DAMAGE YOUR PROPERTY
This company makes use of a company called "Simplex ICT" which will damage your home while installing fibre and decrease your property value with ugly white PVC pipe. The 'technical director' George van Niekerk will be less than useful to you and litigation or the small claims court is best to recover damages. I write this for all consumers to warn you about Afrihost and Simplex ICT. Afrihost on its own is a good company but outsourced this fibre installation to the worst possible service provider.
The sequence of events is as follows: 1. I have decided to put in fibre with Afrihost. Simplex ICT was contracted to do the installation from the pavement to the house. The installation occurred on Friday, 2 August 2019. 2. Before the installation, I was not given a consent form. 3. Before the installation, I explicitly stated that no pipes should be visible in front of the house – in part because (a) of decrease in property value and (b) of renovations which will be done which may get in the way. 4. I stayed with the contractors while installing. Initially the instruction was ignored for one part of the house but I was there so I reminded them of where to put the pipe and the installers followed the instruction on the one side of the house. 5. I returned inside for a while to check on the dogs on the premises being kept in different areas to ensure that they have everything they need and are apart from the contractors so that they can continue their work without disturbance. 6. When I came out, I saw that the instruction was disregarded again and the pipe was placed by the front door, exactly where I told them not to put it. But it was too late – the pipe was installed. The instruction was to put it further to the left so that it is not visible in the front of the house. The installers informed me that ‘it was now too late to change it’. It is this section that was placed contrary the instruction and without consent. 7. The result is (a) of decrease in property value, (b) of renovations which will be done which may get in the way and (c) damage to the wall should it be moved. The damage to the wall would be minimal and I am prepared to close the hole at my cost on the condition that no further to the wall or the surrounding area be done. 8. After the installation was complete , I was given forms to sign: one of them was a consent form. That form, detailing what I consent to should have been given before installation - not after. The installers tried to get me to agree retrospectively to all the work that was done. I refused and explained that they did not have the necessary consent as explained above. On that consent form, I explained what I consented to and did not consent to which corresponds with the text above. 9. On that same day (2 August 2019), I was in contact with a director of Simplex ICT. The director after responding once, has since ignored the consumer. The applicable sections of the consumer protection Act seem to be: s54; s69 onwards. The statement of these provisions in no way limit the applicability of other sections in the Act. 10. I contacted the provincial consumer protector (reference WO***) who responded by saying that (a) the company denies liability and (b) that the provincial consumer office is not able to resolve the matter within its mandate which is confined to alternative dispute resolution mechanisms (ADR). I then contacted that National Consumer Commission (NCC) who referred me to the Consumer Goods and services Ombudsman (CGSO) who was unable to deal with the matter according to their conduct because it falls within the jurisdiction of the CGSO. 11. I then contacted ICASA who told me that they also don’t have jurisdiction.
