********* *****ing my money

I app**** with Afrihost for an LTE-A router and package through the rain network and made a payment from my credit card on 23 November 2017 for R999.00. I had bad service a few days later with regards to my ADSL hosting that I have with them so I cancelled the ADSL, I was considering cancelling the LTE order as well, I sent an email asking how long the refund would take. Afrihost's client services then proceeded to cancel my account stating the following.

"Please note I have cancelled the order as per your request. I have therefore after for the amount of to be refunded back into the card."

I did not request a cancellation of service, I only inquired how long a refund would take, but instead of refunding afrihost debited my bank account for an additional R999.00 on 2 December 2017, for a Rain promotion cancellation fee. I am attaching all emails and proof of the debits. I implore all that read this complaint to not do business with this bunch of *********! They never delivered a modem, which is what the charges were for, they did not provide a simcard, the did not deliver any service but has taken R2000.00 from me! This is crime, they stole my money like a conartist or ***** would do!

According to the CPA: Your right to protection against over-selling and over-booking - Suppliers are not permitted to accept payment or other consideration for any goods or services, if: - They have no intention of supplying those goods or providing those services; and - They intend to supply goods that are materially different from the goods or services, for which payment was accepted. - Suppliers are required to honour the supply of goods or services on specified dates, times and other particulars, if committing to such arrangements in reservations or bookings. - Consumers have the right to demand refunds for full amounts paid in respect of commitments or reservations, together with interest, at prescribed rates, from the dates of payment until the dates of reimbur*****t. The last point clearly allows me (the consumer) to request a full refund plus interest for products that you oversell! Further: In terms of s16 of the CPA, if a consumer has bought goods as a result of direct marketing, then for a period of 5 days after receiving the goods, the consumer can: - return the goods, - cancel the entire contract without penalty, and receive a full refund. I have not received the goods and as a result this precedes the cooling off period of 5 days! I am happy if you reimburse R999 and reinstate the cancellation at the original deal. If you do not I will take you to court and I will close Afrihost!!!

Also as per the order confirmation I was to receive the goods in good working order within 7 - 10 business days. I still have not received any goods from Afrihost. Here is the reply on the email! Hello Owen, Your order has been received "We will deliver your Afrihost Fixed Wireless starter kit in 7 - 10 business days to the address you specified. Upon receipt, simply pop the SIM Card into your Wireless Modem and you're ready to go!"
