Zone Fitness Ignoring Lawful CPA Cancellation Notice
I submitted an online enquiry to join Zone Fitness and was contacted the next day by a sales representative. I signed up for a 36-month membership and paid via EFT before visiting the facility. After my first visit, I found the parking and gym environment unsuitable.
Within the 5 business day “cooling-off” period allowed under Section 16 of the Consumer Protection Act for contracts entered via direct marketing, I sent formal written cancellation requests (two online submissions and one email) to Zone Fitness. These were sent within the legal time frame and I have proof of submission.
Despite this, Zone Fitness has ignored my requests and is attempting to keep me in a 36-month contract. This is ******** under the CPA.
I am requesting: Immediate cancellation of my membership as per CPA Section 16. No further billing except for reasonable costs of my single visit. A refund of my R50 joining fee.
If unresolved within 2 business days, I will escalate this to the National Consumer Commission with proof of my timely cancellation notice.
