DISHONEST SALESMEN AT ZONE FITNESS
• On Friday, 15 January 2021, I went to Zone Fitness in Cape Quarter, where upon request to speak to someone about joining the gym, I was seen by someone named Marvin. • When we started speaking, I pointed out to him that I have been diagnosed with Osteoarthritis, but I am trying to maintain a level of fitness to support my back. • I have been walking daily since the beginning of 2020 but I was looking into maybe doing a full body workout. I also mentioned that I would have to speak to my doctor about it. • I mentioned to Marvin that past history has proven that it might not be a good idea for me to look into something long-term, cos if I should hurt myself, I will be stuck with a contract that I cannot use. • I told him that I stay in Table View and maybe I should look into joining Viva gym instead, (Table View has one) cos I could decide on a month-to-month basis. • He advised me that it will be ok to join Zone Fitness because I have until the end of February to change my mind. I made triple sure by asking him two more times during the consultation and all he told me was to ensure that I bring back the 2 blue slips and the card, should I want to cancel. • He assured me that a gentleman by the name of Michael would show me the ropes for 3 sessions. • The following Monday, 18 January, I went to gym for the gym and found my way around by myself and spent most of the time on the treadmill because Michael was not around. • For the rest of the week, until Friday, 22 January, I figured things out for myself and asked here and there how things worked. By now I was becoming anxious cos if I did one thing wrong, it would put me out of action for quite a while. Michael was still unavailable. • On Friday, 22 January, I started experiencing muscle spasms and decided to speak to my GP about this, who advised me strongly against this and instead suggested that I rather start looking into yoga. • The next Monday, 25 January, I called Marvin but was unable to reach him, (he was either not in yet, busy with a client or something) still being under the impression that I had until the end of February to cancel. I was then informed by one of the ladies who answered the phone to bring back the card and blue forms and then speak to Marvin when I get there. • On Wednesday morning, 27 January, a colleague and I walked to the gym where I saw Marvin and handed everything back to him. • He asked me if I do not want Zone Fitness just to freeze my account, until a later stage, whereupon I informed him that my doctors are totally against me joining the gym. At no point in time did he point out on this or the previous visit that there was such a thing as a “cooling off period”. He advised me that Nandi would do the formalities and call me. • I heard nothing back after that until Monday, 01 February, when Jodie told me that my “cooling off” period had already expired. Needless to say I was alarmed and even more, I was livid, because I specifically addressed and asked Marvin until when I had before the contract officially kicked in and I could no longer retract. I felt that he had ample opportunity to put me in the clear. Firstly, when I queried 3 times about until when I had to change my mind, the two times he did see me at the gym, the following week as well as the day when I handed back the paperwork. In no shape or any form did a “5 day cooling off” period ever come into play. Either Marvin forgot to mention it or he was purposefully withholding information. I then decided to follow protocol and contacted the sales manager a Garth, who responded with the following: Please note that your 5 day cancellation request has been rejected based on the fact that the 5 day clause was not adhered to.and relevant paperwork not handed in timeously.
Should the membership be cancelled a cancellation fee will be required He will notify me in due course about this cancellation fee.
I feel that I will not take this lying down.
I will expose them on social media, I will call radio stations and will see a lawyer about this.
