Wesbank Judgement

<p>Description of interaction between my mother, Debt Collector and I</p> <p> </p> <p>The debt Collector, a white elderly male came to my parent’s house in November/ December 2015 claiming to be from Wesbank and was looking for me. My mom informed him that I was at Akeso Hospital in Parktown a psychiatric hospital. As I was suffering with depression and at no mental state to attend to my affairs. My mother ensured she made payment on my Wesbank account and ensure she paid a bit extra than my normal instalment as I had previously informed her I was in arrears with a monthly payment and had been trying to bring it up to date as there was interest/ collection fees added monthly. Thereafter I have not heard from this man. I paid my account monthly and every month I tried to pay extra even paid R7000 in March. I was hospitalized again in January at Akeso and yet again my mother still ensure to make means to pay Wesbank to show commitment of payment to Wesbank. The only month I missed instalment was in however May I ensured I paid R8000 more than double my monthly instalment which would mean I would be in arrears of R6008.44. I am very committed to bringing this account up to date that when I did not receive my May statement I contacted Wesbank for my statement on the 20th May 2016 so that I know exactly how much and so I could bring the account up to date by paying extra on the 25th June 2016. I knew that I should be in arrears of an amount of R6008.44 including interest, collection fees etc. however wanted the exact amount to ensure I pay extra to bring my account up to date. Then debt collector by the name of Phumzile Dlamini contacted me on the 26th June staying that I was in arrears of R19,320.84. I knew she had not taken into account the R8000 I paid on the 25th June 2016. I was in shock because that would mean my arrears are R11320.84 if you take account the R8000 I paid. Which could not be right she then provide me with a statement and I saw a significant amount of legal fees of R5,312.40. I asked her what the legal cost were for. She did not respond to my e-mail. As proactive as I have been on the account I then informed her that I would make payment of arrears on the 25th June 2016. She then suddenly on the 2nd June informed me Wesbank had a Judgement against me. I was not feeling well and was hospitalized on the week of the 6th June 2016 and unable to be at work. when I returned on the 20th June 2016. I saw that she had sent a Judgement to my e-mail on the 6th June 2016.</p> <p> </p> <p>I do not think this fair practice and I believe that the debt collectors were malicious in their conduct as they knew I was in hospital and I have been making payment even going as far as paying extra on the account. How can they have obtained a judgement on the 13th May while we were making payment arrangement on the 26th May 2016? I have shown commitment into making payment to the account even when I was hospitalized my mother ensure to make payment. I have had a difficult year hospitalized three times but value my commitment to Wesbank.</p> <p> </p> <p>Proposal to Wesbank</p> <p> </p> <p>I Plead with Wesbank to look at the merit of my case and that there is an element of maliciousness in regards to the debt collector. I commit to pay Wesbank R8000 no later than the 30th June 2016 thereafter pay my July instalment and the rest of the arrears to bring my account up to date.</p> <p>i have write a complain on Hellopeter on Tuesday and still awaiting feedback.</p> <p> </p>
