I purchased a new Mazda 323 in August 1997 which was financed by WesBank who then became the legal ‘Title Holder’ of the vehicle.
I finished paying WesBank for the vehicle in August 2000.
I now want to sell the vehicle.
I have lost the original ‘Vehicle Registration Certificate’ but do have a copy of the original document.
I have contacted WesBank via email requesting a duplicate ‘Vehicle Registration Certificate’ and a ‘Letter of Settlement’.
Wesbank requested further details regarding the account and vehicle details.
I have sent WesBank all the documentation that they requested.
WesBank has refused to supply me with the requested documents stating as follows that: because the vehicle is older than 20 years the Wesbank system only allows for data to be stored for 20 years and less. Also, that I may liaise directly with the Licensing Department for assistance. I have, at the recommendation of Wesbank, approached the Licensing Department in Cape Town twice. The Licensing Department refuses to issue me with a duplicate ‘Vehicle Registration Certificate’, stating that ONLY the legal ‘Title Holder’ – in this case Wesbank - can apply for a duplicate certificate. The Licensing Department has issued me with two printouts showing WesBank as the legal ‘Title Holder’. I have forwarded the ‘Title Holder’ printouts to Wesbank and received two replies stating that they cannot assist me. The failure of WesBank to supply me with the documents means that I cannot, to my knowledge, transfer the vehicle into my name and therefore cannot legally sell the vehicle. I do not know what my next course of action should be.
