VEHICLE REPOSSESSED WHILE INSTALMENTS ARE PAID

In 2013 I purchased a vehicle and it was financed by Wesbank.

Initially, for the first two months of my contract, the deductions were made through my account by means of a debit order. However, this arrangement was changed, and we informed Wesbank around end April 2013 that the account would be paid through my wife's payroll at State Security Agency.Wesbank did not activate this instruction and they continued to deduct the instalments via debit order until August when they finally changed the payment date.

Payroll started paying this account from the 23rd May 2013 to date. It should be noted, however, that although Wesbank was receiving payment through payroll, they also continued with the debit order which returned unpaid and they were charging interest at the same time for unpaid debit orders. This accumulated interest and arrears that I was not aware of as the monthly deduction were made through payroll. The arrears in question are now standing at R27 736.14 . On Monday the 29 June, the vehicle was repossessed and I am without a car that is paid for monthly.

I would like to have this matter investigated and intervention made on my behalf.

Peter Petrus Madlozi Nkabinde

Hello Peter Nkabinde,

We thank you for bringing this matter to our attention. After investigating the allegations made herein, we wish respond as follows:

According to our records, the Bank was only advised of the changes in payment method on 21 May 2013 after the account went into default and Collections Solutions had called to recover the outstanding payment. You highlighted that the arrangements for same had not been finalized and that you were aware of the account arrear position as well as your obligation in terms of the credit agreement to settle same irrespectively.

It is important to mention at this point that the Bank is not in a position to institute or effect a salary deduction and that the consumer is required to ensure that payments are received in terms of the agreement. More stringent action became warranted when it was apparent that payment of the outstanding funds would not be forthcoming.

Please contact the account controller for further clarity hereto and to finalise an arrangement for the restoration of the account.

Yours faithfully,

WesBank
