Lack of Customer Care
Good day<br> <br> A Judgment for the return of a vehicle was granted and the vehicle was sold at an Auction years ago. It was sold less its book value and the amount was accepted by Wesbank. I have seen my Credit Profile and have noticed that what is reflecting is the Judgement of R769 637.00, which was for the return of the vehicle not the shortfall. Wesbank has not updated at Credit Bureau as they are obligated to.<br> <br> I have sent numerous emails to service@wesbank since 05/08/2015 and was later advised that I should contact Ms Faith Majabe and my email had been forwarded to her. I have been trying to call her since but in vain. I sent again an email to service@wesbank on 17/08/2015 to request perhaps her email address as I could not reach her but was again told that I should contact her and my email has been sent to her.<br> <br> Can I be advised whether this is the correct customer care?

There is a fundamental difference between a default listing on an individual's credit profile and Judgment because in terms of the definitions prescribed by the National Credit Act (NCA) and Credit Ombud, A default means you are in default of your obligations i.e. you have failed to make the payment as per your agreement. A default is held on the system at credit bureaux for two years and is then automatically removed and it is this default that will reflect the shortfall balance whereas A Judgment is a court order requested by your credit provider when you have not paid your debt. The judgment is held on the system of credit bureaux for five years and is then automatically removed. The details pertaining to the Judgment remain fixed unless if a rescission of Judgment is granted or if the same meets the requirements in terms of amnesty. The amendment of the Judgment is therefore prohibited in terms of South African Law.
