Ignoring my right to be in email communication and telephonic harrassment
<p>I have a trail of emails to Colsol Prelegal. I explained multiple times that I have had a year of personal turmoil. I have been taking care of a family member who had cancer and she needed to get treatment every single day. In addition, there have been two deaths in my immediate family and through all of this my small business has been tremendously affected. I made it very clear that I was absolutely planning on catching up on payment but that I really needed assistance in a more attainable amount. I also made it very clear that I could not predict my future income but that I was trying very hard to get back on track. Whenever I engaged in phonecalls with your collections agents, I was often spoken to in a careless manner and they tried to force me to give definite answers when I was unable to.<br /><br />After multiple calls from rude collectors who were pushy (which I was not able to deal with clearly in my emotional state), I was advised by a lawyer friend to request that all communication needs to happen via email. This way, I could respond in a clear mind and consult him for advice if needed. <br /><br />Every time someone phoned, I asked them to email me instead. They would then send me a standard copy & paste email. I would respond with my personal situation. They would respond in an unhelpful manner. <br /><br />From 'unhelpful email' point onwards, I would start getting non-stop calls from wesbank collectors. I mostly don't answer because I've asked multiple times to be emailed. Then, I when I do answer, I ask to be emailed. <br /><br />This week, on Monday, such an event occured. I answered, asked to be emailed. I was emailed and I responded. I did not receive an adequate response to the email. Your call centres continued phoning. 6 phone calls that I can recall on that day.<br /><br />On Tuesday, the calls started up again. There were 4 calls. On Wednesday, 6 calls. I still have not received any adequate email response.</p> <p> </p> <p>A friend of mine, who cannot actually afford it, offered to help me in catching up on the arrears and My December payment. Yesterday my arrears amount was R2867,04, and December premium R2285,68. I paid a total of R5200. This morning I checked the wesbank account transaction history via FNB online banking, only to see that AFTER my payment was made banking, DCA charges were added again. <br /><br />I understand that Wesbank has the right to outsource to debt collectors. That said, I do not believe that Colsol has been helpful and they have not been assisting me properly. They have been harrassing me and I am having anxiety issues because of their lack of proper assistance. <br /><br />Yes, your contract gives you "rights", but do keep in mind that I as a consumer have many rights, some of which have been violated in this process. I am so sick and tired of the careless bullying. You guys clearly kick dogs when they are down. I will take this matter further, by consulting the relevant consumer protection bodies. This might not matter to you, but if I can gather enough people who have endured your bullying, we will be able to take this further. <br /><br />South Africa is going througheconomic turmoil, and you are only contributing to the awful state of this country by treating customers (Who you make more than enough money out of), without respect or care. <br /><br />As I am sitting here today, you have received every penny I owe you, and if you do not care about me as a customer, then perhaps I could urge you to put a formal notice on your website, stating, that the 72 month road you took with me, does not matter to you. That you do not care about my well being, that you do not care about the fact that I am a young entrepreneur who has been on a great path untill life threw absolutely horrid curve *****. <br /><br />Please put a notice on your website, stating that you lack absolute respect for matters of humanity. That you will not be there for your customer when they kindly ask for assistance in their darkest hour. <br /><br />When my business is back on track, which it will be, I will need to purchase more vehicles. When that day comes, I will consult all possible avenues to avoid having to ever give you any of my business again. <br /><br />I expect any DCA charges that have been added to my account this week to be reversed, as your agents have not been doing their job properly, and they have not been assisting me.</p>

We wish to refer you to your signed Terms and Conditions of the agreement which advise the account holder that Debt collectors fee would be charged on all arrear amounts. When an account is in arrears, we have the right to phone you for payment as you are in breach of your signed agreement. Upon refusal of agreeing to a payment arrangement, the agents will keep calling until payment has been received or a payment loaded and not seen as harassment as the vehicle remains the property of WesBank until settled in full.
