<p>I seriously do not understand how a bank can decide to take your car with only two years left on a 73 month contract. How does that make business sense? Who would recommend a bank like that to anyone. This is basically a *******. Wesbank has collected almost more than half of the R633 000 that I owed them and now they want to leave me without a car plus a debt.</p> <p> </p> <p>This is not a matter of someone who says he can't pay for the car. Yes I defaulted on the payments, who doesn't but that did not stop me from paying my instalments. The least that they could have done would have been to bring me in see what the problem was, work out a plan to pay the arrears and maybe adjust the instalment to accommodate my financial situation.</p> <p> </p> <p>The worst part abou this whole situation is the fact that I only received one email in November 2016 after which it was quite and then there was an email from lawyers calling themselves Fabricius and Engelbrecht who informed me that they had been appointed to handle my arreas. The next thing my kids are traumatised by a Sherriff who showed up and made the whole block of flats aware that he was there to unceremoniously take my vehicle away. Where is the sense of decency and respect. </p> <p> </p> <p>You would think that the law in this cases matter but it doesn't. For starters no effort was made by the lawyers to make an arrangement with me to pay the arrears because they should be able to produce a document that shows my signature where I agreed to a payment plan. Failing which a section 129 letter should have been sent to me. None of that happened. A claim is the made by Mr Fabricius who I called on Friday (30/06/2017) that summons were served on my flat. There is always someone at the flat during the day everyday and there is a caretaker who sees to such things when the tenant is not available, how did we miss this summons? Mr Fabricius then tells it was either pushed under the door or sellotaped to the door. When I tell him no such thing happened he tells me by law he does not need to prove that any of these processes were followed, what matters in court is proof that I defaulted on my payements.</p> <p> </p> <p>I have then been given a settlement amount of R324 000 by Mr Thato Nengovhela which must be paid in 7 days and my 7 days expire on Monday (10/07/2017). Anyone have R324 000 stashed somewhere? In all honesty where am I going to get that kind of money. The vehicle was R430 000 without the finance charges. If I had that kind of money I would have bought it cash instead of going through 7 years of car instalments. The million dollar question is a big institution like Wesbank can't put up with 2 more years of me when they have already put up with 5 years of me. To top it all this is devastating for my kids who have grown so fond of this car.</p>
