Car recovery

On 26 August 2015 my car was repossessed by an agent/tracer. I was surprised because I had made arrangements to pay the amount in arrears. I went to to a debt counselor to seek advice. The debt counselor told me that only a sheriff in full uniform with a court order with a stamp of the court is allowed to repossessed the car. He told me that the agent had no right to repossess the car. They only do so when instructed to do so by their computer system. The counselor told that Wesbank recover about 90 cars a month through these agents. The victims of these ******** repossession are the consumers who do not know their rights. Unfortunately, I'm one of them. I'm asking Wesbank to bring my car back and I will continue with payments as agreed to.

In terms of the credit agreement state that (11.1) You may terminate this Agreement at any time by giving us written notice and by surrendering the Goods to us. This Notice was received via a signed Voluntary termination notice and the conditions applicable to same state that (11.2) Once we are in possession of the Goods, we will within 10 (ten) business days appoint an appraiser to value the Goods, and we will advise you of the valuation. You therefore have 10 days to remedy the situation by paying the outstanding 14 instalments and resume with the credit agreement. Should you require further clarity in this regard, please feel free to contact our agent on *** after discussing the same with the manager who will contact you shortly.
