WeBuyCars Lansdowne & Polokwane – ******** refusal of cash refund under the CPA.
I paid 100% cash upfront for a 2011 Chrysler Grand Voyager. The official condition report **** and stated "no electrical issues". Upon arrival at the Polokwane branch, the electric tailgate was completely broken and the keys were faulty. I officially REFUSED DELIVERY under Section 19 of the CPA. The car has never left their floor or been driven by me. Today, a call centre team manager called me and claimed they are "rejecting my claim" because I signed an email PDI form before payment in Cape Town. This is a direct violation of South African consumer law. You cannot force a consumer to accept delivery of a broken, misrepresented vehicle. WeBuyCars is ********ly withholding my cash payment. I demand my 100% full refund immediately. Ticket ***
I have received a formal written rejection letter from Client Care Advisor Florah Matsapola (Concern ***). WeBuyCars is officially refusing my refund, claiming the vehicle was sold "As-Is" on an auction under Section 55(1) of the CPA, and that I signed the standard Rules of Auction.
I completely reject this bad-faith defense for the following reasons:
1. This was NOT a standard salvage or accident public auction. The vehicle was purchased via your online retail "Price Drop" promotional platform.
2. Point 8 of the WeBuyCars Registration Form explicitly binds the transaction to the truth of the official Vehicle Condition Report (Inspectify Report). The report explicitly declared "no electrical issues" and a "perfect functioning key". This constitutes gross material misrepresentation under Section 41 of the CPA to induce an EFT payment.
3. Under Section 19 of the CPA, the risk remains 100% with the supplier until physical delivery is accepted. I discovered the extensive electrical faults at the pre-handover inspection on the Polokwane branch showroom floor, officially refused delivery, and never signed the final handover notes. The vehicle has never left your possession.
I have formally forwarded this rejection letter and the signed registration form to my appointed Motor Industry Ombudsman (MIOSA) Case Officer under my active case file. I demand that Head Office overrule this branch-level evasion and process my 100% full cash refund immediately.
