WEBUYCARS BRACKENGATE/BRACKENFELL BAD AFTERCARE, REFUND ISSUE

I purchased the vehicle in question, 2007 Jaguar x-type 2.2 D estate on the 22nd of Dec 2025, fully and completely from Webuycars Brackengate (Brackenfell) I paid an excess of R3500 for licencing and documentation on top of the sales price totalling R53,900 I did a test drive with the sales advisor, Ashraf, on the 20th or 21st of Dec 2025, however, we already struggled with the driver door when the sales advisor could not get out of the vehicle and I had to open the door from the outside. When doing the test drive, there were lots of hopping and/or bounce and/or knocking noices from the suspension on the vehicle and assumed it was only alignment and both front wheels had a little deflate which I were fine with + also worth mentioning that the sales person mentioned that it forms part of their condition report, which it did not. It CLEARLY stipulate suspension as "as expected" or "good" which were not the case. When taking the car off the floor, driving away, noticably there were defects on the car which I agreed with for it's age, however, the suspension were not as per listing on condition report as "as expected" or "good" on some components as signed for and I initiated a concern or complaint between the 22nd and 24th of Dec 2025 The sales advisor went on leave on the day I did a deposit on the vehicle. The day I drove the car out, on the 22nd of Dec 2025, I had to take the matters up with a person called Franco Hamilton from the same Brackenfell branch, which is the sales manager of the branch. Noticably, he was empathetic to my circumstance and agreed to have the car tested on the suspension and the front driver door issue. There were quotes done on the suppliers they chose. This was for the suspension parts and the driver door actuator. The service providers could not find a door lock actuator nor rear shocks (which the preferred service provider declined to note defective on the rear shocks) as there were no parts available and it were over the December holidays with general suppliers only opening round the 5th to the 15th of Jan 2026 Webuycars did not supply me with a temporary licence on the buying day and I had to go back to the branch to obtain such on the 29th Dec 2025 This temp licence gave me time to fix the car for licencing and roadwortiness before the 18th of Jan 2026

I went for second and third opinion, and for the "assistance" to get the car done for roadworthiness, as there were "no supplier which could help or could not find parts" it was found that both the rear shocks were also done and needed replacement.

The door actuator I found at a s**** yard for a MUCH greater price (R1,750) as what Webuycars Brackenfell declined through their desired supplier for R16k Webuycars did not want to or declined the vehicle totality on part replacement as it were too expensive for them to replace the worn parts on the given prices from their suppliers. I also found second hand rear shocks at a much more reasonable price (R1,900 for both) at the s**** yard and it were advised that even though it were used, can be used for another 10k drive, which I excepted as the vehicle needed to go for inspection/roadwortiness.

The parts for replacement were agreed upon where I dropped off physically, and per whatsapp, the invoices and payment to Franco for refunds to be done. NOWHERE was anything communicated that Webuycars will not accept liability or declining of the parts/fitment of defective parts for roadwortiness, in fact, the condition report I signed for, and the physical proof of the vehicle how it was, differed and that is a legal indifference to me, even though I signed for the documents as the Webuycars legal dept now stipulate me to have "a null and void" case as I went to do the part buying and replacement myself and they do not take any further remedy on the situation. Why did I go through such lengths if Webuycars will not abide by what the condition report specified as "as expected" or "good" whilst it were in fact defective? I did sign the "agreements", however, from a sales point perspective, the transaction signed for, did not have an option to provide insight on the defective parts, or did not have a section where I could provide concern on defective parts NOT listed, to be replaced as part of the sale I would'nt have accepted the vehicle if Webuycars, upfront, declined any and all future defective product replacement but this was not part of the condition report signed for. You cannot mention that something is "as expected" or "good" but in fact is defective. I as a consumer, who does not have mechanical experience, will except it as written, but then will have to jump through many hoops to sort out stuff which was not part of any listing as defective. The condition report specifies the products to be of "good standing" and that there would'nt have been a "problem" for issuing of licence. This was NOT that part and there were extra additional expenses covered by me, but on a reasonable request of a refund for the sourcing, fitment, and secured/drivable condition of the vehicle. Furthermore, the door lock actuator AND the rear shocks HAD TO BE fitted to see if it works or not for warranty perspective - so this was fitted included in the invoice provided The fitment were done without programming of such actuator also. I myself programmed and fixed the door lock actuator for the purpose of using the vehicle as it did not want to lock at all and could I not drive and leave the car open/unattended. This is not an acceptable scenario. I bared the cost of the programming and the setting of the actuator myself and agreed to settle this amount myself because of Webuycars taking their time for finalisation and possible lapsing of the temporary licence but only for the fitment. I cannot "assume" responsibility of a defective part if this is not per their own documentation as acceptable condition if it aint.

For the rear shocks, because of the possible lapsing and getting closer to the 18th for the temporary licence expiry, I had no choice but to also fit the rear shocks. This was also on telehonical conversation between myself and Franco

Carin Pietersen (Client care advisor) and Franco Hamilton never conversed about the issue at hand as I specifically requested of Franco to deal with Carin from his side to no avail on incident nr 119166

I produced all evidence and proof of payments and this was excepted by Franco at the Brackenfell branch The "approval" for the front suspension issues were done and the fitment done as accepted liability from the dealer. The front door lock actuator were also forming part o the transaction however, "lapsed" because I had to fit (had no choice) this unit.

After completion of the last mentioned, I submitted all and everything to Webuycars - Carin Pietersen on given concern raised, 119166 After back and fro from email evidence, Carin and/or Webuycars - as a final, advised that there will be no refund to any claim produced

This it totally unacceptable if Franco accepted,the dealership manager knowingly also know about the defects, and advise given that client care will sort the refund out. And all thisfor only R5,000!!!!!!!!!

Your legal department already took a look at the deal and paperwork AND Carin already sent the "final verdict" that Webuycars are not taking this matter as full and final settlement but alternatively rather declined the refund transaction which was due by you, Webuycars?
By when can I then expect a turn-around and/or feedback + refund pertaining this scenario?

A fair amount of time has been given and from a business perspective, a fair enough time allowance to finalise the above mentioned as your comment suggested: "We are currently looking into this matter and will update as soon as possible" would be 5 business days?

This is unfair business practices and key client satisfaction or rather TCF does not fit in this business at all as it seems.
1: The product design intended for specific use clearly have had defects not listed on the condition report as proof of it were that some components were already replaced which Webuycars Brackengate/Brackenfell accepted responsibility thereto yet when the other malfunctioning components were to be replaced/removed and fitted/electonically programmed, the "blame" falls on the consumer?

2: Clear information were never given on circumstances around the specifics which Webuycars declined to mention or stipulated on their documentation signed for. Now from a legal perspective, you drill me because I signed for this? Yet I mentioned that there were no space or allowance to generate or highlight a concern to be fixed? How is this fair practices?

3: The advice given at the time was suitable, however, when digging deeper, and actually getting opinions and quotations by the branch and by myself (inconveniencing me further), the fact of the matter was that were "hidden items" which your company specified as "as expected" or "good" and turned out it was beyond defective, inoperable, incomplete or damaged beyond repair. I singed the condition report yet Legal dept wants to say that I defaulted or faulted?

4: I faced an unreasonable barrier when laying a complaint with the company, Webuycars, where Carin prolonged the circumstances and the company then declining the refund?
When I asked further questions I was denied and/or it was "final"?

There should be a utilization of complaint processes to identify systemic issues and improve procedures.
