We were sold a vehicle with undisclosed faults

My husband purchased a 2013 Mini Cooper Countryman from you in December 2025 and we are now formally lodging a complaint regarding the car. Since purchasing this vehicle, it has been unreliable and undriveable. We were only able to drive it for about 2 to 3 weeks max, never a full month, before experiencing a series of serious mechanical failures that were not properly disclosed at the time of sale.

Shortly after purchase, the vehicle then completely stopped running. We found out that the clutch had failed and was severely worn. This defect was not listed on the dekra report provided at sale. We thought it was not a major fault although it was not listed. We decided to replace the clutch at our own cost as we needed the car for the rest of festive season holidays. After the clutch replacement, we drove the car for about 2-3 days and more and worse further faults appeared. Air conditioning stopped working while we were driving the car..apparently is was due to a worn belt (the mechanic flagged this while he was replacing the clutch)... we stopped at a garage while attempting to check the issue with the belt, a petrol station attendant told us he knows the vehicle and that it was known to have engine mixing issues and knew the previous owner. Yes, there was a white, milky residue on the engine water tank cap. Out of frustration, we contacted the previous owner whose details were still stored in the car and he indicated that the vehicle previously had clutch problems. we have a recording of this call. ...the car was taken back to the mechanic for belt replacement...fine the car was fixed and shortly after that it started showing a new different fault , full engine power no longer available, drive moderately. We have now incurred significant expenses and we are financially strained, yet the vehicle remains unreliable and undrivable .

Given that these defects manifested within 6 months of purchase and were not listed on the dekra report meaning were not disclosed to us , we are invoking our rights under Section 56 of the Consumer Protection Act.

We hereby formally request that you either: Take full responsibility for diagnosing and repairing all defects that were not listed on dekra report at no further cost to us or accept return of the vehicle and provide a full refund.

Should this matter not be resolved promptly, we will have no option but to escalate the complaint to the Motor Ombudsman of South Africa and the National Consumer Commission. Thank you
