WE SELL DEFECTIVE CARS,********* TO BUYERS

My dad and I went to we buy cars in Midstream last Saturday 18/08/18, looked around, the salesman Fred seemed very helpful as I looked at a grey polo and grey GTI and immediately said these cars were in accidents and I should not even look at them. He then took my dad around looking for Polo which I was looking for. He took us to a white polo 1.6 comfortline, I asked to take it for a test drive and while I was driving the car, a short distance, not on the freeway, the car was pulling to the right and I told him about it, he told me it just needs balancing and alignment nothing major. Got back to the dealership and my dad and I asked him if the car had been in any accidents and he immediately said no. But what was strange when I was inquiring about the other cars he said they just get the cars in and don't inspect the cars so they don't know about the cars. Now that I'm thinking about it, it shows the deception. As he immediately said the Polo wasn't in any accidents and was a clean car. How would he know that if they don't know about the cars and they just get them in. Now this Polo was a higher price than the other cars but in my price range. I asked him again is he sure that the car wasn't in any accidents and what does he think about the car as I don't know much about cars neither does my dad especially when it comes to accident damage cars, and he told my dad and I that the car is a bargain and that it was definitely not in an accident showing us on the side of the engine that the original VIN number was still on. I then decided to take the car. So he took us to the seating area and gave my dad the banking details. He told us to take a seat he would be back. He came to check on progress of payment and my dad informed him that he was having trouble as his daily limit was too low. Fred advised my dad that he could go down the road to Absa and come back. I took my dads phone as I know more about cellphone banking whereas my dad doesn't as my mum always did all the banking and she has passed on. So while helping my dad raising his daily limit, Fred took out the paperwork for me to sign, he never explained anything to me and he saw I was distracted trying to do the payment and the paperwork. He took advantage of this. As I was doing all of this he was just telling me where to sign and just write "I agree" in the blocks, which I wasn't even given the time to read it carefully, me being a first time buyer I didn't know better and trusted him. In this time I managed to raise my dads daily limit and do the payment to we buy cars. He went to check if the money came through and as soon as he checked that he said its all done, he will drive the car out. He said he will post all documentation to me after I send him my lease agreement to him. He never gave us an Invoice, actually nothing. I called him over 5 times yesterday from 8am to tell him what was wrong with the car. Actually I sent him an urgent message on Saturday after I got home. I drove the car out and on the freeway I could not keep the car in 1 lane this is from Centurion to Alberton. I battled to drive the car as it was pulling so badly to the right. My nephew then checked the car on Sunday 19/08 and saw that the CV joints are gone, that the car was in a front smash, the steering rack or column is damaged which I can now relate to why the car was pulling so badly to the right. The front mag isn't the same as the other 3. None of the defects of the car was told to us by Fred. The bottom panels as u open the door are all out. The Cd player does not work. I filled R500 petrol in the car as the car basically had less than a quarter tank of petrol. After calling Fred on numerous occasions yesterday his manager still did not call me. Fred mentioned to me which I have recorded on my phone that I could bring the car back and they will refund me but his manager will have to authorize it. Eventually at 16:15 I sent Fred an sms and told him that since his manager doesn't want to call me after all his empty promises, I am now taking legal action and am going to report them to MIMOSA. Very quickly did Henry the manager call me and he already knew everything and gave me a straight "NO" when I told him that I want a refund. he further goes on to say, "Do u know that you bought a car under auction"? I have the recording of this on my phone. I said it was not under auction I did not bid for the car. He again says " I have the paperwork right here with your signature and you bought the car under auction". By this time I was irate. I told him that either he refunds me and I bring the car back or I am going to get my attorneys involved and I read him the CPA out. He said I must do whatever I like and shouting at me on the phone so I dropped the call. My understanding is that if you buy a car under auction, you would have to register for an auction, pay a deposit and then bid on the car of your interest. I didn't bid for any car. So I didn't know what papers I had signed nd nothing was explained to me. So I was being taken for a fool as Fred has seen I was trying to get the payment done and he took advantage of the situation and made me sign.

As per the feedback provided to you via email by our Branch Manager, Henry Harber, unfortunately, you did purchase one of our Auction vehicles.

As per the agreement you signed, the sale does fall under Auction Terms and Conditions and therefore, we will not be able to assist in this regard.
