We Buy Cars profess innocence after advertising and selling a 2017 model as a 2018 model
We Buy Cars (Pty) Ltd advertised and sold a 2018 model motor vehicle to me on the 6th June 2019. Upon delivery of the registration papers it became clear that the car was sold based on a misrepresentation as it was in fact a 2017 model. When the difference in value between the 2 models were claimed, they insisted the agreement to be cancelled, the motor vehicle returned and the purchase price refunded. I chose to keep the vehicle and demanded damages. They are only willing to settle for approximately 50% of the difference in value, which proposal I declined. Legal action based on **********-, alternatively negligent misrepresentation, is now in process.

We acknowledge receipt of your complaint.
We have been advised that our legal department has been in touch with you.
We wish to state once again that the representation made, pertaining to the first year of registration of the vehicle, was an innocent error and we have continuously attempted to resolve the matter with you.
Upon realizing the error we immediately indicated that we are willing to cancel the transaction and refund you in full, which you declined demanding a reduction in the purchase price. We made you an offer based on what the price of the vehicle would have been had we priced the vehicle as a 2017 model, which reduction you declined demanding to pay book value for the vehicle.
We indicated to you that book value is a guideline, which explanation you did not accept.
We then reduced the price even further which you declined again. We also wish to state that, even based on the value you wish to pay for the vehicle, is the offer considerably more than a 50% reduction in the difference between the value you claim and the purchase price. Your statement is therefore misleading.
We will continue to seek a resolution with you.
