Warranty Dispute and Poor Service Experience with WeBuyCars

My brother purchased a vehicle 20/12/2025. He started having issues and went back to RIchmond, and spoke to Viwe, he advised my brother to take the vehicle to 1 of your workshops. They could not find the problem, and advised him to come back when it happen. That was February/March 2026. In May, he went again, and again spoke to Viwe, and Viwe advised him to speak to the Sales Manager, Ashley. I also went to speak to Ashley, and he advised the vehicle is out of warranty, which I found very strange, but he made me feel like an idiot, as if I do not know anything about vehicle, mind you, I worked at Car Service City. My brother then decided to log a complaint end of May, and the provided him with a list of RMI Accredited Workshops. He took the vehicle on 03 June 2026 to Point S, where they assessed the vehicle, gave him a quote.Today 10 June 2026, they (WEBUYCARS) sent him a letter stating they cannot fix said problem as it is out of the 6 month Warranty. Firstly, he went and logged the complaint February/March at the branch, then May he physically logged a complaint as the problem was getting worst, and he was getting no joy from the branch, this all happened within the 6 month warranty. From20 December 2025 till 20 May 2026, is 5 months. Please let us know how you calculate 6 months. And even though he only took the vehicle to Point S on 03 June, he was well within the 6 month warranty. PATIENTLY AWAITING A RESPONSE FROM WE BUY CARS.

Under the South African Consumer Protection Act (CPA), the 6-month imp**** warranty is calculated from the exact date of delivery. If you took delivery on 20 December 2025, your 6-month CPA warranty ends on 20 June 2026. [1, 2, 3]
The CPA provides strong protections regarding the quality and durability of goods. Key details include: [1]
  • Remedy Choice: If the vehicle develops a major defect or fails to meet expected quality standards within this period, you have the legal right to choose whether you want the dealership to repair it, replace it, or refund you. [1, 2]
  • Start Date: The warranty is tied to the date of delivery, not the purchase date, though these are often the same day. [1, 2]
  • Warranty Extension: If the dealer repairs the vehicle and the exact same defect reoccurs or a new major failure happens within 3 months of the repair, the dealer must replace the vehicle or refund your money. [1, 2]
  • Voetstoots Exemption: Dealerships cannot legally override CPA warranty rights by selling a used car "as is" or "voetstoots" without explicitly detailing and obtaining agreement on specific faults. [1, 2]
If you would like, I can help you with specific next steps:
  • Determine exactly how to draft a complaint or rejection letter to the dealer.
  • Provide an overview of how to escalate to the Motor Industry Ombudsman of South Africa.
  • Help distinguish between normal wear and tear and legally actionable defects. [1]
