Very very bad experience!!!!

We bought a vehicle 25/11/2017 at the Centurion branch, took it for a test drive and nothing seemed wrong ( even the sales person ensured me that the car is in a good condition and KIA is a good car, when we arrived home in Rustenburg the light stayed on, even if the key is removed from the ignition , I took the car to a Auto Electritian and they removed the dash and found that the wiring is burned from steering wheel to fuse box inside and then from there to fusebox outside, they confirmed that someone tried to fix it by them selves. I paid a large sum to do rewiring and fix the problem. A week later we went out of town and on the way back the engine went dead and I pulled of the road, the car refused to start and I knew that something big is wrong like the Timing chain broke, I phoned a mechanic and he confirmed what I expected. After the festive season I took the car to someone to repair the car, it took about a weeks labour and alot of parts like Timing chain, valves...ext, I took al the invoices and forwarded it to We Buy Cars and they refused to pay a cent on the repairs. I know that we signed a document that states there is no garentee, but I think its poor service and customer relation to sell a car without making sure that everything is in good condition. I will definitly never refer someone to We Buy Cars, with my experience I can only say that they sell damaged goods.

Kindly find that I have received feedback from Malcolm van der Bank, one of our Sales Managers. He advised that he had a discussion with you with regards to your complaint, and as per the Trade Deal Registration Form he sent through to you, you agreed to our wholesale terms and conditions, that your wife, Sue-Mari Vets signed.

Unfortunately, as per the second condition: "All goods are specifically sold without warrantees and / or guarantees and are sold by the seller with no obligation to repair whatsoever. No come-backs. No refunds. No exchanges." we won't be able to assist in the paying of the repairs.

Please keep in mind that, at our facility, there are hundreds of vehicles for sale, ranging from nearly new with very low kilometres, to well-used cars with substantial kilometres and wear. We advise all our clients to take the time to fami****ise themselves with our terms and conditions before purchasing.

We also encourage our clients to ensure that the vehicle's specifications are adequately suited for its intended purpose and to inspect the vehicle thoroughly to that effect and perform a test drive.

The Terms & Conditions are clearly displayed in our reception, on the price cards as well as on the terms & conditions form that you signed.

Good day, as per your reply: The Sales person never told us that the vehicle wasn’t in a good condition – instead he told us that the vehicle is mechanically in mint condition and that the only faults were the few scratches and two places on the upholstery that has tears. We bought the vehicle 25.11.2017 and within the first day off purchasing the vehicle we had the wires that burned front to back and did not realized that that’s only a small portion off what’s to come and has since spend nearly R30,000+- to repair the vehicle so it can be mobile. Since January we only got the reply form you stating that you won’t assist us by reimbursing us for the monies already spent on repairs… and after doing research we found that the CONSUMER PROTECTION ACT backs our side as we are in the 6 months by law and requests that We Sell Cars adhere to this law. The Consumer Protection Act applies to every transaction occurring within the Republic of South Africa, and to all goods or services that are supp**** or performed. One of the consumer rights is the "Right to Fair Value, Good Quality and Safety", but what does this mean? Your right to return goods and seek redress for unsatisfactory services - Consumers have the right to return unsafe or defective goods and request a full refund for such goods, provided this is done within a reasonable period. Consumers are entitled to the following, when entering into agreements/contracts with suppliers: High-quality services, which consumers are entitled to expect; and use, delivery or installation of goods that are free of defects and of a quality that persons are generally entitled to expect, if any such goods are required for performance of the services. Suppliers are required to remedy any defects in the quality of services performed or goods supp****; or refund the consumers a reasonable portion of the price paid for the services performed and goods supp****, in the event of these being sub-standard. Your right to safe, good quality goods - Consumers are entitled to receive goods or services that are of good quality, in good working order and free of any defects. Therefore, In terms of the Consumer Protection Act a Consumer may request/ be entitled to: a refund; return purchased goods; be entitled to have goods repaired; and/or have the goods replaced. Imp**** Warranty of quality - In terms of s56 (read with s55) of the CPA, all goods sold to a consumer are sold with an imp**** warranty of quality, that cannot be contracted out of or revoked. The warranty gives the consumer the right to receive goods that: - are reasonably suitable for the purpose that they are intended to be used for, - are of good quality, free of defects and in good working order, and - will be durable and usable for a reasonable period of time. Within 6 months after the delivery of any goods to a Consumer, the Consumer may return the goods to the Company, without penalty and at the Company’s risk and expense, if the goods fail to satisfy the requirements and standards contemplated above and the Company must, at the direction of the Consumer, either: - repair or replace the Failed, Unsafe or Defective goods; or - refund to the Consumer the price paid by the Consumer, for the goods. If the Company repairs any particular goods or any component of any such goods, and within 3 months after that repair, the Failure, Defect or Unsafe feature has not been remedied, or a further Failure, Defect or Unsafe feature is discovered, the Company must: - replace the goods; or - refund to the Consumer for the price paid by the Consumer for the goods.
