Good day, The email below was sent on the 02.03.2023 and no response. The car will be returned.

We reach out to you today regarding a breach of section 55 & 56 noted below:

“Section 55: Consumer's right to safe, good quality goods - Section 55 (2) (a), (b) and (c) respectively gives a consumer the right to receive goods that are reasonably suitable for their intended purpose and are of good quality, in good working order and free of defects; and is 'plainly' useable and durable for a reasonable time.

13. Section 56: Imp**** warranty of quality - Section 56 (1) provides that where there is an agreement concerning the supply of goods, there is an imp**** provision that the retailer warrants that the goods comply with the requirements and standards contemplated in section 55. Subsection 56 (2) gives the consumer the right to within six months after taking delivery of the goods to return the goods to the supplier. If the supplier does not meet the requirements and standards contemplated in section 55, then the supplier must, without imposing a penalty and at the supplier's risk, either repair or replace the defective goods under section 56 (2) (a) or refund the consumer the price the consumer paid for the goods under section 56 (2) (b).” In short, we purchased a vehicle on the 30 Sep 2022 and was not advised that the vehicle was “not roadworthy”. There wasn’t an online Dekra report to view as the vehicle was on newly on the floor.

The sales agent, X Moyo, failed to advise myself or my wife about the vehicle being unroadworthy.

We have now been advised that we will bare these costs which as we have been advised, is ******* and ********* behavior on We Buy Cars’s part.

This the 2nd vehicle that we have purchased “cash” with the 1st was from the Silverton branch who gave us no hassles in terms on roadworthy, vehicle registration and the like.

We require that the matter be resolved in 5 working days and failure to respond will result in us returning the vehicle (as we are well within 6 months).

Below is what we require from We Buy Cars to do:

Pay for roadworthyPay for renewal of license discPay for registration documents

Sending an email does not mean the matter is closed. Its CLEARLY NOT....

The car will be returned as per the consumer act. Please forward your compliance officers details.

THE CAR WILL BE RETURNED TO THE BRANCH.
