Motor vehicle sold without our consent

On Friday 2024/09/27 at about 13:00, I personally reserved a silver volkswagen polo vivo 1.4 comfortline (5DRS) reg no: JG 01 ML GP kilometer reading 67 000 B rated stock number ;FEE301053 to the amount of R2500 deposited to the account of We buy cars website whereby the car was at JHB South branch (we buy cars) with the selling price of R124 900.

Then on monday 2024/09/30 me and my life partner Anna Dlamini proceeded to the branch after receiving a call from WE BUY CARS employee alerting us that we must come to the branch and pay the amount of the car and collect it.

Upon arrival we were approached by an unknown male who then introduced himself to us as the we buy cars sales representative by the name of Siya.

We then informed Siya of our reason to be there.Stated: *Paying the amount of the reserved car. *And the collection of the car.

The sum of R124 500 was paid from my FNB Acc no:***9 to we buy cars FNB Acc no:***5 combining it with R2500 that was paid to reserve the car, to make it the total of R127 000 which included the admin fee of R2100. After all the payment being done I have instructed Siya to register the car under my life partner Anna Dlamini. The process was then followed whereby Anna Dlamini signed terms and conditions on the We Buy Cars database assisted by Siya.

Siya then started telling us that they have a problem with their system on registering the car under my life partner's name at the admin office.

We then request Siya if it is possible to get the car as we have paid it in cash and we will come to register it on wednesday as we had other commitments on tuesday,however he refused on releasing the car stating that he can't because its not fully registered under my partners name.

The arrangement was then made between Siya and i telling him that i will come to collect the car on wednesday and he promised me to fully register the car under my partners name when the system is back online. We then left the branch leaving the car behind with intention to collect it on wednesday as per our agreement.

On tuesday 2024/10/01 during the day i received a whatsapp call from Siya telling me strories that i didn't understand saying We buy cars won't sell the car to us again because its faulty and has severe damages and that the WE BUY CARS mechanic who is busy checking the car and he will send me the pictures of the damages. I then instructed Siya to stop doing that as I had purchased the car knowing the problems and the damages as per the DEKRA REPORT.

Later on during the night Siya sent the whatsapp pictures to my phone which i noticed that the pictures are not the same with the car we bought.

On wednesday 2024/10/03 in the morning I received a call again from Siya telling me that the mechanic is busy fixing it. I responded to Siya that how can he do that while i've instructed him the day before not to fix anything to the car, i then immediately drove to WE BUY CARS to get clarity.

Upon arrival we went straight to Siya and told him that we here for the collection of the car and he responded to me that the car is still at the mechanic and it won't be released until the car is being fixed ,whether we've bought it cash or financed.

I requested Siya if i can see his manager he then went to the office and called unknown male who introduced himself to me as Siyas manager by the name Koketso Mashilane, i related the matter to the manager the way Siya has handled the situation after everything was explained to him, his response was that the car was sold to another buyer on tuesday 2024/10/01 and there's nothing they can do as the car has been already released from the branch.

The only thing they could assist with is to give us the refund or look for another car.

I was not happy with the decision he made, I requested to see the area manager and I was informed that he/she has back to back meetings. The fact that I could not see or talk to the area manager, I requested Koketso Mashilane to lodge the concern complaint to the relevant authorities of WE BUY CARS and he assisted me and provided me with the reference number: 765 539.

May you kindly assist with following requests *WE BUY CARS to return the paid car to us( 2019 polo vivo reg no:JGO1MLGP) *We won't accept any refund from we buy cars as we accumulated loan interest from bank loan FNB tha we took to purchase the car.
