Misrepresentation on the roadworthy of a purchased vehicle from We Buy Cars

I bought a Mercedes Benz ML 250 from we buy cars. I took delivery of the vehicle on 24 April 2021. I took their warranty policy which stated that I need to take the car in for service within 1000km. I took the car in as stipulated and I was told that I need to replace the control arm bushes. What is important to note here is that I was about to purchase the same vehicle from them but I turned down the application because I saw that that car had control arm bushes issues, as per the Dekra report. I then decided to purchase this current vehicle because it had a clean Dekra report with nothing needing to be repaired.

it was quite surprising that the vehicle needed to be repaired when the Dekra report had nothing to say about such repair.

The vehicle was shaking when I app**** the brakes so I called innovation group to tell them about the issue and I was told that I was covered and I need to take the car to Mercedes Benz. I took the car to Mercedes Benz and I was given a quote of R75 107.80 in order to get it repaired. Innovation group said they would only pay R17 000.

This obviously was too expensive and I could afford to pay such a shortfall. I then had to pay Mercedes Benz R2500 in order to have the car released back to me after they had diagnosed it.

I then took the vehicle to a RMI approved workshop who lodged a claim with innovation group. this quote came up to R42 987. They also picked up that the car had a water pump issue.

I informed innovation group and they said they would only pay R8000 for the control arms and R7500 for the water pump issue. I informed We Buy cars about this and was told that I should send them the quote of the workshop and they would see what could be approved and they would pay for it,. Bear in mind that the vehicle is less that 6 months old.

we buy cars then returned and stated that they would only pay for the water pump which is R7500(which innovation group was already paying). this leaves me with a shortfall of over R33 000. When speaking to we buy cars, I am told that the control arm bushes are a wear and tear issue and they are not liable for that.

This makes no sense because the Dekra report said nothing about control arm bushes and it was on the strength of this report that I purchased the vehicle. it is also strange that the arm bushes became an issue when I took the vehicle for service 4 days after I had taken delivery of the vehicle.

In essence, we buy cars misrepresented the vehicle when it was sold to me. Had I known that the vehicle had these issues I would not have purchased it. Further, it brings into question how the vehicle passed roadworthy because its impossible that these issues arose within 4 days of delivery. Now I am expected to pay to get the vehicle to a functioning state as was advertised.
