"Informal/Verbal" Breach of Contract

Submitted a request for my car to be evaluated, received a response almost immediately and was contacted shortly by Anton however.. Car was evaluate the next day and I was offered R125 000 which I advised was low offer, evaluator then requested my settlement amount which I advised was R132 000. He made a few calls and then agreed that they will settle the bank at R132 000 but it has to be done immediately. I advised that I needed time to decide of which at the end of day I confirmed that they can have the vehicle at R132000. Schedule a further appointment for two days later to finalize the deal and when I met with the evaluator I informed him that my settlement amount is R104 000. He advised that they cannot continue with the deal as the settlement amount is different from what was initially quoted and that he was doing me a favour by settling the bank.

Please help me understand the difference between settling the bank directly or paying me the value and I settle the bank? You was prepared to offer me R7000 more if you settled the bank( even though I had **** about the settlement amount) but you was not willing to do so when you had seen my settlement amount being less. It goes to show that you are willing to ******* customers who are unsuspecting or unaware of the impact their settlements amounts have versus a fair evaluation of their vehicle.

Hi Ashwin,

Kindly find that your willingness to share your settlement details with us resulted in the original offer changing. We were also unable to confirm your vehicle details, and when the information was finally made available, we were able to make an accurate offer.

You also supp**** incorrect vehicle details (the vehicle was listed as a facelift, when in fact, it is a pre-facelift) and did not accept the original offer.

With regards to the settlement, kindly find that this is merely part of our process. We settle the bank for all our clients and complete all the paperwork, after which the remaining amount is paid directly to them. This is to ensure that everything is in order throughout the deal.

Your response is clearly deviating from my QUESTION and your facts are incorrect. The reason you send an evaluator is too view the vehicle and make recommendation or an offer, your online form also requires details of the vehicle like model , eg, this car is a 2015 Model which was stipulated, it did not ask whether it is a face lift , as a customer am I expected to know the difference between face lift and non? This is the home work you should be doing then before making an offer and your offers should be based on the value of the vehicle, not what the customer owes. Settling the bank is part of the process that you have established as a company when purchasing a financed vehicle from a "potential" customer. No further response or justification required as you clearly do not have the best intentions of the customers and that is quite clear from your response and the negative reviews you have received.
