Dishonest Car dealer

Sold me a vehicle with undisclosed faults Told me to sue them for the refund, unwilling to even fix the faults like a reputable dealership will do. vehicle is stuck I cannot drive it and they just don't care. this vehicle could not possibly gone for testing in the state it is, but Webuycars have their own inspection company that is putting unsafe vehicles on the roads. Went to their head office and no help at all, was just told to do whatever i need to do but they not going to assist me. the faults they declared on purchase was acceptable, and not what we found out after the sale with major safety issues not disclosed. they told me to log a complaint at MIOSA if I am unhappy with their investigation. I will be going to my lawyers and NCC since they have no problem in selling defective vehicles to the public. I cant even start the car to take it to a mechanic!

Rejection of Outcome – Concern 153922 – Request for Reconsideration under CPA
Dear WeBuyCars Customer Care Team,
I refer to your response regarding Concern 153922, lodged on 26 May 2026, relating to the 2009 Ford Bantam 1.6i XLT A/C Pick Up Single Cab, stock code 736E03915, purchased from your Germiston Branch on 17 May 2026.
I do not accept the outcome provided as a final resolution.
I acknowledge that I signed the Sales Agreement, Buyer Registration Form and Inspectify Condition Report. I also acknowledge that the Inspectify Condition Report disclosed certain defects, including the windscreen, ball joint, handbrake, CV joints, link rod dust cover, rims/tyres and body panels.
However, my complaint is not limited to those disclosed items.
I obtained an independent repair quotation from The Garage Bryanston, dated 26 May 2026, which identifies extensive mechanical and safety-related defects with a total estimated repair cost of R76,666.48. This repair cost exceeds the purchase price of the vehicle, which was R64,300.00.
The quote identifies several defects and repair items which were either not disclosed in the Inspectify Condition Report or appear to contradict the positive findings in that report. These include, but are not limited to:
  • Radiator leaking water
  • Water pump requiring replacement
  • Thermostat and housing
  • Multi belt tensioner
  • Front wheel bearings and hubs
  • Gearbox selector leaking
  • Steering rack
  • Front shocks and top shock mountings
  • Brake booster
  • Front brake pads and discs
  • Rear brake shoes
  • Clutch kit and clutch slave
  • Timing chain noise on start
  • Ignition switch fault
  • Expansion bottle and cap
  • Headlight wiring requiring auto-electrician check
  • Possible oil leak requiring engine wash and further checks
This is significant because the Inspectify report stated that the vehicle showed “good baseline mechanical condition”, that the engine started reliably, that the cooling system was functioning properly, and that the gearbox shifted smoothly. It also rated several areas such as the cooling system, wheel bearings, shocks, steering rack and gearbox as good, as expected, or without major concern. The independent quote therefore raises a serious concern that the vehicle’s actual condition was materially worse than what was disclosed or represented in the Inspectify report. Your response states that the “issue indicated on the Condition Report is the subject of client’s complaint.” I do not accept this as a sufficient explanation. Please provide a detailed item-by-item comparison showing where each of the above defects was specifically and clearly disclosed in the Inspectify Condition Report. I further place on record that:
  1. The vehicle was purchased on 17 May 2026.
  2. The complaint was lodged on 26 May 2026, only nine days later.
  3. Your own response confirms that only 693 km had been travelled since delivery.
  4. The defects identified are extensive, material and costly.
  5. The quote includes items that were not clearly disclosed in the Inspectify report and, in several cases, appear to contradict the report.
I therefore request that WeBuyCars reconsider its decision and provide one of the following remedies:
  1. Cancellation of the sale and refund of the purchase price; or
  2. Repair of the undisclosed defects at WeBuyCars’ cost; or
  3. An independent third-party inspection at WeBuyCars’ cost, with the outcome to be considered under my CPA rights.
Please also confirm:
  1. Whether the vehicle passed a roadworthy test before sale.
  2. Whether the vehicle was sold as roadworthy or not roadworthy.
  3. Whether Inspectify is independent from WeBuyCars.
  4. Why the Inspectify report reflected the cooling system, gearbox, steering, wheel bearings and shocks positively when the independent quote now identifies significant repairs in these areas.
  5. Whether WeBuyCars will arrange its own inspection of the vehicle before maintaining its rejection.
I place on record that I am exercising my rights under the Consumer Protection Act. Your own response confirms that your terms and conditions do not limit or alter my CPA rights. If WeBuyCars maintains its refusal, I request that you provide your final written position so that I may escalate the matter to MIOSA, the National Consumer Commission, and obtain legal advice. Please provide your written response within 5 business days. Regards,
