Misleading and irregular conduct

My sister asked me to look into her contract after she cancelled it with Vox as they were demanding that she pays a cancellation fee.

The contract she agreed to was a month to month contract which would in turn ensure that she could terminate with no cancellation fee. This was also guaranteed to her by the relevant sales representative.

She is now getting harassed and receiving threats that she will be handed over if she does not pay the cancellation fee of R4000. I even wrote to Vox explaining that there generic terms which provide for a Fixed Term Agreement does not apply to her as she was on a month to month and all she needed to do was provide one calendar month notice of cancellation.

My sister has been harassed and rudely spoken to with threats of being handed over for a fee she is not liable for. It is not only misleading to demand this payment but highly irregular.

If you have agreed to a month to month contract it cannot be assumed it is fixed.
