Employed at Centurion Vox Telecom office as support technician and acting Night Shift Manager. - Shana was the manager on duty.
On the 10th of January 1917 at approximately 13h00 he got up from his chair and collapsed at the same time having a seizure. Gavin assisted during the seizure until he regained consciousness and an ambulance was called. Due to the excruciating pain that he was experiencing after regaining consciousness the paramedics opted to administer a tranquilizer to subdue the him. He was then transported without a designated vox employee present to Tswane District Hospital. At the hospital doctor suspected that the arm may be dislocated and they tried to unsuccessfully relocate it. They did treat the facial abrasions and admitted him to a ward. The decision was made to transfer him to Steve Biko Hospital because their X Ray machine was defective.
He was transferred to Steve Biko Hospital on the 11th of January 2017.He was diagnosed with a fracture dislocation humerus shoulder and neck.On the 15th of January operated on and an open reduction of the internal fracture of the right shoulder was done and repaired with implants. Operation was not successful and on the 25th of January the procedure was redone.
He was booked off from the 29th of January and could resume duties on the 1st of March. Every few days Walter would phone to hear when he will be able to resume his duties. After 1 month of recuperating Luenardi decided to go back to work because he was fearing that he will loose his position at Vox and was able to drive in his disabled state with one arm to work and back. He resumed his duties but now at a slower pace.
He was constantly in pain and due to this taking pain****ers to execute his duties.During this period the arm began to get infected. Steve Biko was not willing to assist, insisting that the problem was just an inflammationLuenardi went to a private doctor that tried to drain the infected arm and prescribed antibiotics.Every few weeks she had to repeat the treatment however it was already septicemia. During this period Luenardi asked Nadine for the incident report but she called him into her office and told him that if he pursue this he would see her in court. No paperwork was handed over.
On the 09 March 2017 at 21h00 Luenardi had another attack at work and again lost consciousness. He slid down his chair dislocating his left arm and further damaging the right arm. According to Polelo a co worker he could hear bones breaking when he hit the floor. An ambulance was called and they delivered him to Kalafong Hospital again the designed VOX employee was absent. His family collected him from Kalafong and took him to Steve Biko. There was no beds available at Steve Biko and he slept under the counter on the floor for 2 nights in the ICU.Dr Landman relocated the left shoulder and arranged for admission. X rays showed that the arm is busy growing on skew. He was discharged and given a date for the removal of the septic implants.
On the 24 of April 2017 the septic implants and were removed and he was discharged on the 27th with medication. He resumed his duties although he developed oozing ulcers on his shoulder that indicated septicemia was still present. Again consulted a private doctor who assisted with draining and treating the infection. Nadine's reaction when i inquired about the paperwork of the 2 incidents was that this was not injuries on duty.
On the 4th of June 2018 he was admitted for the removal of the shoulder bone that died due to the second incident. He got phone calls from Pam and Walter wanting to know when he will return to work. He send a mail to Pam and Anna explaining that he will be back at work on the 13th of June 2018. On the 13th he returned to work but was taken to Marius Venters office by Ana and Jo Anne. He was very unsympathetic with the doctors request that Luenardi should be placed in a less stressful environment. He blamed Luenardi for his staff shortages and insinuated that he do not care about the other employees at work. He was told to go back home with out pay until he is able to perform his duties.
A few weeks later Pam requested that he attend a meeting at work. He was handed a document and asked to sign that he resigns and that he will not take any legal action against the company. They also told him that if he wants his position back he will have to re apply. Present was Anna and Pam on a video call. He refused to sign the document which is attached.
The next stage of the operations were delayed twice.
Due to the infection his skin turned yellow and a tumor again developed on the arm again which was a oozing puss. He was lethargic and had no energy. A video of this was send to Dr Viljoen and he opted to admit Luenardi within days.
On the 27th of November 2019 he was re admitted into Steve Biko for a shoulder debridement - the first phase for a reversed shoulder replacement. He was in isolation until the 21st of December 2019 to arrest the spread of the infection which was now becoming a life threatening issue.
Admitted again in Steve Biko for a shoulder 2nd stage revision on the 18th of June 2019 and and discharged on the 21st of June 2019.
His follow up visit with the surgeon was on the 15th of October 2019. He was declared fit for work bearing in mind that the arm has got 30 degree mobility. A long road continuous physio still lies ahead.The arm will never return to its original state.
The recent Hospital bill is over R 80 000.00 which he will never be able to repayseeing that it is not easy to get a job and that very few companies wants so employ a partially disabled person.
He asked for the 2 incident reports and was told they are not aware of the 2nd incident.
According to labour law he should have received the best care with a injury on duty and therefore should have been send to a private hospital accompanied by a designed employee. The hospital bill is for the employer. After the issue with Maruis and the resignation letter nobody from Vox made an effort to contact him again.
His sick leave was used up due to the days trying to arrest the infection. No sick leave can be used up for a injury on duty.
If the right procedures were followed by Vox during the fist incident two a half years of his life would not have been wasted and filled with pain and more anxiety.
Please note that he has not been diagnosed as a epileptic and is not taking any medication for it. He has done a MRI and EEG which showed up negative results for epilepsy. This was causes by severe work stress due to he having to manage tasks that he was not trained for and the work load trebled.
