VW PASSAT DSG GEARBOX PROBLEM

On 5 August 2011 I purchased a demo 2010 VW Passat 1.8 DSG from Lindsay Saker Airport with 23000km on the clock. One year later I experienced clutch judder in First gear. This was repaired under warranty. 40,000 km later the same problem occurred. As the vehicle was out of warranty this repair at Autohaus Centurion cost me R 24,000-00. Upon querying this a lady contacted me and told me it was fair wear and tear. She was adamant that the technicians considered it fair wear and tear. She also informed me that she would get a technician to speak to me about the "fair wear and tear". This never happened. My question is how can a DSG gearbox which I always use in auto mode could only last for 40,000 km? I have owned Golf'and Polo's with manual gearboxes that never had a clutch problem. How is this then possible?
